• <br /> Richard Terry noted the other proposal is suggesting <br /> cutting through a new area of trees in order to effectuate <br /> the plan. The Cape Cod Commission is very much in favor of <br /> using pre-exist-ing sites rather than venturing into virgin <br /> areas . <br /> Dennis Bal arini argued that said virgin area is <br /> located within the Industrial Zone and that sooner or later <br /> someone will clear the trees- in order to construct some <br /> type of building. <br /> The Chairman then opened the discussion to Public <br /> Comment recognizing Walter Sullivan, attorney for the <br /> property owner of the Industrial Communications and <br /> Electronics, Inc. site. <br /> He suggested that any waiver or relaxation of the <br /> setback requirement section 7A would require a variance <br /> from t-he Zoning Board of Appeals . Also, this not only <br /> protects buildings within the fall zone, it protects <br /> activities as well . He- stated this is a public safety <br /> feature covering all activities on the site. <br /> Richard Terry asked if the Cape Cod Commission had <br /> been concerned with this issue. <br /> r. Sullivan suggested the Commission was concerned, <br /> that the matter had been brought up several tunes, and that <br /> the project was approved subject to Planning Board concerns <br /> regarding setback. The Co n'U' ss ion did not apply the local <br /> By-law in their decision making. <br /> Richard Terry stated, ..I find that impossible to <br /> believe. " <br /> Mr. Sullivan stated "The only reason that ray client <br /> has -spent all of this time, energy, and money is because h <br /> truly believed that there was one site eligible." The <br /> other project requires a variance, which. is very difficult <br /> to obtain from the Zoning Board of Appeals, and there is <br /> nothing that states it can be waived. <br /> In response to the previous speaker' s comments Mr. <br /> oyal responded, every tower will have vehicular traffic <br /> and parking; and that- the Treason the owner is seeking <br /> approval is so that he can sell the property. <br /> 21 <br />
