• <br /> In response to a question by Dennis Bal arini, Ms . <br /> Calabrese stated guarantee of fencemaintenance would be <br /> required by conditions of the Special Permit . Attorney <br /> Kenney also noted there are conditions within the Cape Cod <br /> Commission decision requiring ongoing maintenance at the <br /> site. <br /> Richard Term inquired whether or not the Cape Cod <br /> Commission addressed/reviewed zoning issues with regard to. <br /> this project. <br /> Attorney Kenney responded, "Quite frankly, they danced <br /> around it ." He stated his client examined various sees <br /> and came to the conclusion that theirs is the only site <br /> that complies with the Zoning By-law. Applicant asked the <br /> Cape Cod Commission, on numerous occasions, to interpret <br /> their technical bulletin, which the Zoning By-law is lased <br /> upon. The repeated response from the Commission was "well, <br /> it' s just a technical bulletin. " They would not respond to <br /> the question, stating it was the purview of the Town of <br /> Mashpee under the Zoning By-law. <br /> Tara Calabrese agreed the Cape Cod Commission did loop <br /> at zoning and skirted some of the issue . <br /> Attorney Kenney continued stating a letter clarifying <br /> Applicant' s position regarding space on the cell tower has <br /> been submitted. All Town Departments will be given space <br /> at a discounted rate, with exception to the Police and Fire <br /> Departments (no charge imposed) . <br /> Documentation has been submitted regarding different <br /> types of lighting appropriate for the tower, as required by <br /> the Board. <br /> Submission site developed detailed Pl n showing <br /> the revised structure. <br /> Dennis Bal ari-ni inquired as to the number of carriers <br /> indicated on the Plan. <br /> Tara Calabrese responded stating there are five leases <br /> at this point, five carriers have signed on to this <br /> facility. The tower however is built to house six <br /> carriers, the plan reflects the maximurn number of carriers <br /> possible. <br /> 2 <br />
