3. There shall be only one access driveway, to be located between the proposed storage area and <br /> Echo Road as shown as "Proposed Access Driveway" on the approved site plan, unless the <br /> applicant is unable to obtain an access easement or license over the parcel identified on the <br /> Mashpee Assessors' Maps as Map 19, Block 3, in which case the applicant shall inform the <br /> Board, shall obtain a curb cut permit from the Mashpee Department of Public Works and may <br /> construct the driveway instead in the alternate location shown as "Optional Access Driveway" <br /> on the plan. <br /> 4. No hazardous materials shall be allowed on the premises. Storage shall be limited to residential <br /> / commercial construction materials that a builder would normally purchase at alumber yard <br /> or supplier. <br /> 5. The kettle hole depression in the proposed storage area shall be filled only with clean natural <br /> soil containing no deleterious material, building debris, demolition materials, stumps, trees, <br /> brush, hazardous waste, asphalt, contaminated materials of other unsuitable substances. <br /> 6. Materials shall be stored only within the area shown on the site plans as"Proposed 0.99 Acre <br /> Storage Area". Prior to storage of any materials, the applicant shall provide to the Board a plan <br /> of the actual storage area as cleared, stamped by a registered land surveyor, indicating the <br /> square footage of the area cleared. No further expansion of the cleared area may be made <br /> without further approval by the Board and review and approval by the Cape Cod Commission <br /> as a Development of Regional Impact. <br /> 7. Prior to storage of any materials, the driveway shall be constructed, said construction must be <br /> inspected and approved by the Planning Board's Consulting Engineer, and the required <br /> inspection fees submitted to the Board. <br /> 8. All conditions of this special permit shall be binding not only upon the applicant but also on all <br /> successors-in-interest and assigns of the applicant. <br /> 9. Prior to clearing of the proposed storage area, the applicant shall provide to the Board a copy <br /> of this decision as recorded with the Barnstable County Registry of Deeds, including an <br /> indication as to the book and page at which it was recorded. <br /> VI. Expiration. Extension or Modification <br /> Pursuant to Massachusetts General Law, Chapter 40A, Section 9 and Article IX, Subsection 174- <br /> 47.C.(5) of the Mashpee Zoning Bylaw, this special permit shall lapse within 2 years, which shall not <br /> include such time required to pursue or wait the determination of any appeal from the grant hereof, <br /> if a substantial use hereof is not sooner commenced except for good cause. Initiation of <br /> construction of the proposed building shall constitute "substantial use"for these purposes. <br /> The applicant shall require a specific determination of good cause by a favorable vote of four <br /> members of the Planning Board if claiming an extension of the 2-year period, except to wait the <br /> determination of any appeal from the grant hereof. <br /> -3- <br />
