f <br /> Mashpee on March 2 and March 9, 2001. The hearing was continued on April 4, April 18 and <br /> May 2, 2001. <br /> W. Dedsion and Findings. <br /> On May 2, 2001 the Planning Board closed the public hearing and voted to make the following <br /> findings and grant a special permit authorizing the project, with the conditions enumerated <br /> below. The members of the Planning Board were recorded as follows: Dennis H. Balzarini, <br /> Martine Meijering, Matthew F. Malone and Beverly Kane and Associate Member Steven Dolan <br /> were recorded as voting in favor of the decision. No members were recorded as voting against. <br /> 1. The Property is located in the R-5 Zone as depicted on the Town of Mashpee Zoning Map, <br /> but was located in the R-3 zone at the time of filing the preliminary subdivision plan. <br /> 2. The project satisfies the requirements of Massachusetts General Law Chapter 40A, in that it <br /> complies with the general purposes and intent of the Mashpee Zoning By-Law. <br /> 3. The proposed development complies with the lot area and dimensional requirements set <br /> forth in the Zoning By-Law for cluster subdivisions. <br /> 4. The project does not lie within a Floodplain Zone, the Mashpee and Quashnet River <br /> Protective Districts, a Groundwater Protection District or an Area of Critical Environmental <br /> Concern. It does lie within the Otis A.N.G.B. Accident Prevention Zone and is subject to the <br /> height and occupancy restrictions subject to that Zone. <br /> 5. A water quality report was provided, as required by Article VI, Section 174-27 of the Zoning <br /> Bylaw, dated April 5, 2001 by C3H Environmental, Inc., 31 Tosca Drive, Stoughton, MA <br /> 02072. The report included water quality sample results for three pairs of monitoring wells, <br /> numbered #1 through 6 (one with screen set at 100 feet below grade, the other at 6 feet <br /> below the apparent water table) located on lots 1, 10 and 18. The locations had been <br /> approved by the Mashpee Board of Health on February 16, 2001. <br /> 6. Based on the amount of wastewater Flow projected to be generated by this project, the <br /> proposed systems of wastewater treatment and stormwater management and the <br /> mitigating measures required by the Cape Cod Commission for this Project, the Board has <br /> made the findings required by Article VI, Section 174-27.C. that the Project will not have a <br /> significant adverse effect on public health or safety, aquatic vegetative resources, any <br /> fisheries or shellfish beds or other wildlife due to hazardous or toxic materials, roadway <br /> drainage or sedimentation or excessive nutrient levels. The Board has also imposed a <br /> number of conditions regarding water quality monitoring to determine whether these <br /> findings will continue to be met in the future. <br /> 7. The Project plans were reviewed by the Board's Consulting Engineer Charles L. Rowley, <br /> whose interim report to the Board was by letter dated March 21, 2001. Mr. Rowley's letter <br /> included a number of comments and recommendations. In response to Mr. Rowley's <br /> comments, amendments were made to the plans, and a second letter was submitted by Mr <br /> Rowley Dated April 18, 2001 indicating that all of his previous concerns had been <br /> addressed, with the exception that further confirmation was needed regarding the sizing of <br /> -2- <br />
