Authori <br /> Authority for the Planning Board to require water quality monitoring and provisions for <br /> the protection of groundwater and surface water quality in projects requiring Special <br /> Permits from the Board is found in Massachusetts General Laws Chapter 40A, Section 9, <br /> which states that "Special Permits may be issued only for uses are in harmony with the <br /> general purpose and intent of the ordinance or by-law, and shall be subject to general <br /> or specific provisions set forth therein; and such permits may also impose conditions, <br /> safeguards and limitations on time and use." The general purpose and intent of the <br /> Mashpee Zoning By-law, reflected in the minimum lot size requirements of Section 174- <br /> 31 as well as the specific provisions of Section 174-27, clearly indicate the protection of <br /> groundwater and surface water quality. <br /> All provisions included herein exist beyond and independent of the authority for any <br /> groundwater discharge permit issued by the Massachusetts Department of <br /> Environmental Protection or the Mashpee Board of Health. <br /> H. Pur ose <br /> The purpose of this document is to describe a water quality monitoring program for this <br /> project, to outline responsibility for the monitoring program, and to provide for <br /> corrective action should indicated water quality conditions so dictate. The document <br /> also specifies a reporting process to the Planning Board both on a regular basis and in <br /> cases of violations of the specified water quality standards. <br /> III. Groundwater Monitoring Program <br /> a. Purpose <br /> The groundwater monitoring program is intended to provide baseline and post- <br /> operational data on the parameters of concern in non-industrial wastewaters for <br /> locations both upgradient and downgradient of the project. <br /> 9 <br />
