EPA, Mass DEP, the American Water Works Association or similar authorities and <br /> be delivered immediately to a laboratory certified in the relevant discipline and <br /> category by the EPA or by the Mass DEP under 310 CMR 22.11. <br /> Results of the sampling and laboratory analysis shall be submitted to the <br /> Planning Board, Local Water Resources Management Official and Board of <br /> Health. <br /> e. Long Term Monitoring Program <br /> The applicant, his heirs and assigns, including any homeowners association <br /> established to own common facilities within the dubdivision covered by this <br /> document, shall be responsible for the completion and funding of a groundwater <br /> monitoring program at each of the required monitoring wells. Those items to be <br /> tested are the following: <br /> pH <br /> Specific Conductance <br /> Total Nitrogen <br /> Total Kjeldahl Nitrogen <br /> Nitrate-Nitrogen <br /> Ammonia-Nitrogen <br /> Chlorides <br /> Sodium <br /> Water Elevation based on USGS datum <br /> The testing shall be done on an annual basis, on approximately the 1' day of <br /> October. <br /> IV. Responsibility <br /> The applicant, his heirs and assigns, including any homeowners association or similar <br /> organization to which the applicant transfers ownership or roadways or other common <br /> facilities within the project site, shall be responsible for all costs associated with the <br /> emplacement, construction, relocation, collection, analysis and evaluation (including <br /> distribution of results) of monitoring stations, wells, samples and other items required <br /> under this monitoring program. Where no association or other body was to be <br /> established to own and maintain facilities, in lieu of the applicant, upon completion of <br /> the project, the applicant shall establish an endowment account with the Town to pay <br /> the costs associated with the monitoring program, or an association shall be established <br /> among property owners in the project to contract for and fund the required monitoring <br /> program. If an endowment is to be established, the applicant shall obtain a certified <br /> estimate, by a firm or firms established in the field of hydrogeologic studies and water <br /> quality monitoring, of the annual costs required to conduct the specified monitoring <br /> program and of the amount of the endowment required to produce the necessary <br /> income to the Town to fund the monitoring program. <br /> Unless an endowment account is established, the applicant shall provide an alternate <br /> mechanism to guarantee proper funding of the monitoring program.
