MASHPEE ZONING BOARD OF APPEALS <br /> Petitioner: Habitat for Humanity of Cape Cod, Inc. <br /> Owner of record: Town of Mashpee <br /> 6 Park Place Way <br /> Mashpee, MA 02649 <br /> CP-2011-48 <br /> have a U factor of 0.30 or better; the building envelope will have an R factor <br /> exceeding code by 10%. <br /> 6. Landscaping will be comprised of native vegetation and will be drought tolerant. <br /> 7. The Project calls for construction of a gravel driveway with a paved apron from <br /> the edge of the paved road to the property line. <br /> 8. The Project will be served by public water. <br /> III. FINDINGS <br /> 1. With only 224 affordable housing units (3.5%) in the Town of Mashpee as of <br /> June 30, 2011, the Board finds that the Town has a continuing need for affordable <br /> housing and that this Project will provide such housing. The threshold for <br /> Chapter 40B is 10%. The Board finds that the Project is consistent with the <br /> Town's Affordable Housing Plan. <br /> 2. The Board finds that the Petitioner has considerable expertise and a vested interest <br /> in developing and managing affordable housing. <br /> 3. The Board finds that the Project is consistent with the houses in the immediately <br /> surrounding area. <br /> 4. The Board finds that the conditions imposed in the following section are <br /> necessary in order to properly address local concerns. The Board finds that such <br /> conditions will not render the project uneconomic. To the extent that such <br /> conditions do render the project uneconomic, the Board finds that the local <br /> concerns in imposing the same outweigh the statutory requirements for the <br /> affordable unit that has been proposed. <br /> IV. DECISION AND CONDITIONS <br /> Upon Motion of Board Member William A. Blaisdell, seconded by Board <br /> Member Jonathan D. Furbush, the Zoning Board of Appeals voted unanimously at the <br /> Public Hearings on December 14, 2011 to grant a Comprehensive Permit to the Petitioner <br /> for the proposed Project; subject to the following conditions: <br /> 1. Except as otherwise required by the conditions imposed by this <br /> Comprehensive Permit, the project shall be developed, constructed and <br /> completed in conformance with the Plans. <br /> 2. Under the Land Disposition Agreement, the Petitioner will select purchasers for <br /> the dwelling in accordance with established procedures at a sale price consistent <br /> 4 <br />
