{ 16 Great Aeck !10ad Xbrih; ��:in'tEcir°�r .)IQShpee,Massachusetts OP-649 MASHPEE ZONING BOARD OF APPEALS Decision for a Variance V-2011-50 David M. and Ana Ferris Registry of Deeds Title Reference: 36 Seconsett Point Road Book: 15324 Page: 39 Mashpee, MA 02649 Map 124 Parcel 38 A Petition was filed on November 21, 2011 by David M. and Ana Ferris for a Variance from Section 174-33 of the Zoning Bylaws concerning setback from water and wetlands for permission to construct an addition, breezeway and deck onto a pre-existing, non-conforming home on property located in an R-3 zoning district at 36 Seconsett Point Road (Map 124 Parcel 38) Mashpee MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on November 25, 2011 and December 2, 2011, a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on December 14, 2011. The following members of the Board were present and acting throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell, James Reiffarth and Ronald S. Bonvie. Board Member James Reiffarth stepped down from this Petition and took a seat in the audience. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. Engineer John Slavinsky from Cape & Islands Engineering represented the Petition. At the Public Hearings on October 26, 2011, the Board voted to grant Mr. and Mrs. Cornelius Ferris, owners of 38 Seconsett Point Road, permission to demolish their dwelling and replace it with construction of a single-family home on their property. Rather than demolish their dwelling, Mr. and Mrs. Cornelius Ferris have decided to excavate and move their dwelling at 38 Seconsett Point Road and attach it to their son's existing home on property located at 36 Seconsett Point Road. Proposed lot coverage at 36 Seconsett Point Road will be 19.6%. The Board of Health has approved the proposed new septic system which will accommodate five bedrooms. The Conservation Commission has also approved the proposal and issued an order of Conditions.
