{ 16 Great Aeck !10ad Xbrih; <br /> ���:in'tEcir°�r .)IQShpee,Massachusetts OP-649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> V-2011-50 <br /> David M. and Ana Ferris Registry of Deeds Title Reference: <br /> 36 Seconsett Point Road Book: 15324 Page: 39 <br /> Mashpee, MA 02649 <br /> Map 124 Parcel 38 <br /> A Petition was filed on November 21, 2011 by David M. and Ana Ferris for a <br /> Variance from Section 174-33 of the Zoning Bylaws concerning setback from water and <br /> wetlands for permission to construct an addition, breezeway and deck onto a pre-existing, <br /> non-conforming home on property located in an R-3 zoning district at 36 Seconsett Point <br /> Road (Map 124 Parcel 38) Mashpee MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 25, 2011 and <br /> December 2, 2011, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> December 14, 2011. The following members of the Board were present and acting <br /> throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. <br /> Blaisdell, James Reiffarth and Ronald S. Bonvie. Board Member James Reiffarth <br /> stepped down from this Petition and took a seat in the audience. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Engineer John Slavinsky from Cape & Islands Engineering represented the <br /> Petition. At the Public Hearings on October 26, 2011, the Board voted to grant Mr. and <br /> Mrs. Cornelius Ferris, owners of 38 Seconsett Point Road, permission to demolish their <br /> dwelling and replace it with construction of a single-family home on their property. <br /> Rather than demolish their dwelling, Mr. and Mrs. Cornelius Ferris have decided to <br /> excavate and move their dwelling at 38 Seconsett Point Road and attach it to their son's <br /> existing home on property located at 36 Seconsett Point Road. Proposed lot coverage at <br /> 36 Seconsett Point Road will be 19.6%. <br /> The Board of Health has approved the proposed new septic system which will <br /> accommodate five bedrooms. The Conservation Commission has also approved the <br /> proposal and issued an order of Conditions. <br />
