MASHPEE ZONING BOARD OF APPEALS <br /> David M. and Ana Ferris <br /> 36 Seconsett Point Road <br /> Mashpee, MA 02649 <br /> V-2011-50 <br /> No comments were received from abutters. <br /> GENERAL FINDINGS: <br /> The subject property is located at 36 Seconsett Point Road and consists of 18,861 square <br /> feet of land. <br /> VARIANCE CRITERIA/SPECIFIC FINDINGS: <br /> • a literal enforcement of the provisions of the By-law would involve substantial <br /> hardship, financial or otherwise, to the Petitioner due to the following <br /> circumstances: <br /> o the unusual, long and narrow shape of the subject property, which <br /> especially affects such land, but does not affect generally the zoning <br /> district in which it is located. <br /> o the subject property is impacted by salt marsh and wetlands, thereby <br /> restricting location of the proposed addition. <br /> o location of the proposed Title V septic system limits location of the <br /> proposed addition. <br /> • the proposal will be an attractive addition to the existing dwelling on the property <br /> and to the neighborhood; installation of a new septic system will be a vast <br /> improvement to the property; therefore, desirable relief may be granted without <br /> substantial detriment to the public good and without nullifying or substantially <br /> derogating from the intent or purpose of such ordinance or by-law. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> for grant of Variance relief. Upon motion duly made and seconded, the Zoning Board of <br /> Appeals voted unanimously at the Public Hearings on December 14, 2011 to grant the <br /> Petitioner a Variance of 8 feet from the setback requirements from water and wetlands to <br /> allow for the proposal. This Decision is conditioned upon compliance with Cape & <br /> Islands Engineering plan entitled: "Single Family Residence Addition. Proposed Sewage <br /> Disposal System Prepared for Ana & David Ferris Hse. No. 36 Seconsett Point Rd., <br /> Mashpee, Mass. Date: Nov.16, 2011, Revision: Nov.21.2011". <br /> 2 <br />
