At this point ApplicantIS Attorney requested and was <br /> .L � granted the opportunity to step outside of the Meeting room for <br /> discussion purposes. <br /> Upon his return to the Meeting, Attorney McLaughlin made <br /> references to a Plan entitled, Subdivision Plan of Land for <br /> Kevin Andrade in Mashpee, MA, dated July 23, 1986. Making <br /> indications on the Plan, Attorney McLaughlin offered a suggestion <br /> that Lots 1 and 2 to be served for access by driveways off of <br /> � Christina Road; with one driveway on Lot 3 as close to Lot 2 as <br /> possible. Attorney McLaughlin then commented Applicant would <br /> require permission to construct a gravel road (temporary) to the <br /> � <br /> end of Lots 1 and 2 . <br /> } The Chairman asked how Applicant would propose to arrange <br /> for Christina' s Road in the long run. <br /> € <br /> Mr. Andrade responded the object would be to build out the <br /> i <br /> three lots, utilize the money from the sales to construct the <br /> road and complete the remainder of the development. <br /> II ,SOW Attorney McLaughlin interjected they would seek Release of <br /> the Lots at that point. <br /> The Chairman asked if security would be posted, or create <br /> the Covenants which appear to be missing. He informed Applicant <br /> e <br /> It would be his option as to how it would b posted. <br /> it Attorney McLaughlin suggested perhaps it would be best to <br /> file standard road construction Covenants in an attempt to <br /> clarify the issue. <br /> At the point the Chairman determined this to be a <br /> complicated situation, that he is not prepared to make a decision <br /> at this point, requested additional time for consideration and to <br /> consider the proposal under advisement . The Chairman then iced <br /> v o <br /> ' an ongoing concern for Lot 3 . He stated that he would favor a <br /> .�. 3ust arrangement negotiated between Applicant and Town Counsel; <br /> but made it clear no decision would be made this date. <br /> � At this point there was some discussion regarding issues <br /> raised, as well as concerns raised from Board Members regarding <br /> M <br /> interpretation. of Town Counsel ' s letter and the issues raised <br /> therein.
