1 <br /> 1 <br /> The Town Planner suggested the date of November 4. <br /> 1998 be <br /> changed to read November 3, 1998. <br /> The Chairman entertained a motion be made in this matter. <br /> MOTION: Chance Reichel made a Motion in favor of <br /> F <br /> presentation of the Article for the Town Meeting warrant, as ' <br /> presented; which Motion was seconded by Dennis Balzarini and so , <br /> voted unanimously. <br /> ! <br /> r <br /> At this point. the Assistant Town Planner informed the Board <br /> of an action taken by the Vermont Attorney General ' s office to <br /> file a nation-wide suit against the e FCC. A letter writing <br /> campaign has been proposed which would enable the Massachusetts <br /> Attorney General to join in the State' s Rights Suit. ` <br /> The Chairman made reference to and quoted from the letter of <br /> request for support received from the Vermont Attorney General . <br /> The Assistant Town Planner provided copies of a draft letter [ <br /> of support for the Board' s review. The Chairman paraphrased. from " <br /> said draft response. <br /> The Chairman suggested the letter of support be amended to <br /> read. '? . . . it is of great concern to those of us who value. . . " <br /> rather than, " . . . is an insult. . . " and that it be signed by all <br /> r <br /> Board Members. Upon agreement of these changes by Members of <br /> the Board, the Assistant Town Planner agreed to prepare a <br /> revision for presentation at the January14 1998 Meeting. <br /> g. <br /> Release of Covenantt� <br /> David Hendrick/Kevin Andrade-old Barnstable Road-3 Lots <br /> The Chairman reconvened this matter and recognized Counsel <br /> for the Applicant in this matter, who introduced himself for the <br /> Record as, Attorney Stephen McLaughlin. <br /> Attorney McLaughlin requested clarification of issues before <br /> the Board in this matter; releases with regard to lots with <br /> frontage on old Barnstable Road., whether or not a Covenant <br /> exists, and whether or not zoning issues apply as they would {� <br /> pertain to the lots in question and/or the subdivision in <br /> general . , <br /> The Chairman interpreted Town Counsel ' s letter that both <br /> issues are questions and concerns . He explained that to the r <br /> Board' s understanding, they were not presented the approved <br /> Plan indicating an easement and direct access on old Barnstable <br /> ; j Road.
