relating to the Subdivision under discussion (grandfathering) , <br /> Town Counsel has advised the Board they are not obligated to <br /> release Covenants, that the time frame for grandfather rights <br /> began in 1987, therefore said rights have expired. <br /> . <br /> g P <br /> Attorney McLaughlin argued the possibility of a 1990 ' <br /> p y <br /> beginning date for grandfather rights has yet to be determined. ' : <br /> The Town Planner informed the Board that Town clerk cannot <br /> lie .� <br /> be reached for a number of weeks, upon her return Town Counsel <br /> = will contact her in order to determine the circumstances <br /> _ regarding signatures in this matter,The Chairman commented that due to h t e complexity of this 1 <br /> matter it is unclear as to whether or not these lots should be <br /> built upon. The Town Planner clarified. the Building Inspector ector A.ht <br /> determines whether or not to issue Building Permits. The <br /> Covenant issue being currently before the Board- and Town Counsel <br /> having determined it to be at the Board' s discretion to release � <br /> any of the lots under discussion. <br /> At this point Mr. Rowley responded. to an inquiry made by the � <br /> Chairman earlier in the Meeting. Mr. Rowley stated the driveway loll, <br /> for Lot 102 is located on the far end of the lot. The line of <br /> sight is "fairly decent" along old Barnstable Road, travelling � <br /> from Falmouth. He did note however, vision difficulties li 'd� , <br /> travelling west on old Barnstable Road with a car coming out to <br /> make a left-hand turn. He suggested clearing the line of sight <br /> on Lot 102 would probably improve it enough He also suggested <br /> securing the driveway regardless of what happens with the back . <br /> lots. It l <br /> Dennis <br /> s B al�arini stated he has driven through the area under <br /> discussion; and that he would approve of Lot 102 being cleared to ; <br /> improve the line of sight. � <br /> John Kuchinski stated his approval of a sight easement <br /> pp g <br /> clearing, and driveway relocation twelve (12 ft. ) feet to the <br /> westerly lot line regarding Lot lot . He further stated he has ,q <br /> "no problem" with Lot 3, but he is skeptical about the remainder ,' <br /> of lots at this point. (There was discussion regarding <br /> g g emergency <br /> g y <br /> equipment access. ) <br /> The Planning Board specified road security would be , , <br /> it <br /> required. Mr. Rowley explained the reason for surety in an <br /> amount sufficient for the Town to complete road construction, if <br /> necessary, according to the approval on the Plan, to insure <br /> proper access for the two houses in question. <br /> The Chairman clarified the procedure to be either the <br /> Planning Board will retain Covenants until the subdivision is <br /> built; or one and one-half (1 1/2) times the amount of money 'M <br /> necessary 1� <br /> essary to build the subdivision is posted, to insure that the ' � i� <br /> r! <br /> F <br /> �N <br />
