i <br /> The Board instructed the Town Planner to draft a Decision to this effect to be <br /> filed with the Special Permit information and to he used as reference when the complete <br /> sever line/discharge area revised plans are sub fitted. <br /> Performance Guarantee <br /> Cushman Brownie Trust-Shellback way <br /> Release of Road Covenant for Shellback way and Seit way <br /> The Chairman called this matter to order and recognized Katie Eppers, <br /> representing the Applicant who provided original releases and offered to answer and <br /> address any concerns made by the Board. <br /> The Town Planner explained the location of the first release to he on Shellback <br /> Way into the Deer Crossing Condominium entrance and in front ofthe Rockland Trust <br /> Bank; the second release pertains to an old -lot subdivision plan approved where the <br /> Rockland Trust Bank is now located, which plan was subsequently replaced b -lot <br /> ANR plan and which covenant is still on record. He suggested the Board sign off`on the <br /> releases in order for the land to be transferred. <br /> There being no further Board or Staff comments the Chairman entertained a <br /> motion. <br /> MOTION: Dennis Bal arini made a Motion to release the Covenant for <br /> Shellback Way; which Motion was duly seconded by Thomas *Hara and so voted <br /> unanimously. <br /> MOTION: Dennis Balzarini made a further Motion to release the Covenant for <br /> Seapit way; which Motion was duly seconded by Thomas O'Hara and so voted <br /> unarnmous y. <br /> Haring ascertained this action to be the free act and deed of the Board the <br /> Planning Board Secretary notarized three copies each '`1elee of Covenant <br /> Agreement, Cushman Brownies Trust, Shellback Way, Mercantile way, Dots 19 and 20, <br /> Land Court Plan o-fir—F and - —F. <br /> Signatures: Beverly A.
