i The Board instructed the Town Planner to draft a Decision to this effect to be filed with the Special Permit information and to he used as reference when the complete sever line/discharge area revised plans are sub fitted. Performance Guarantee Cushman Brownie Trust-Shellback way Release of Road Covenant for Shellback way and Seit way The Chairman called this matter to order and recognized Katie Eppers, representing the Applicant who provided original releases and offered to answer and address any concerns made by the Board. The Town Planner explained the location of the first release to he on Shellback Way into the Deer Crossing Condominium entrance and in front ofthe Rockland Trust Bank; the second release pertains to an old -lot subdivision plan approved where the Rockland Trust Bank is now located, which plan was subsequently replaced b -lot ANR plan and which covenant is still on record. He suggested the Board sign off`on the releases in order for the land to be transferred. There being no further Board or Staff comments the Chairman entertained a motion. MOTION: Dennis Bal arini made a Motion to release the Covenant for Shellback Way; which Motion was duly seconded by Thomas *Hara and so voted unanimously. MOTION: Dennis Balzarini made a further Motion to release the Covenant for Seapit way; which Motion was duly seconded by Thomas O'Hara and so voted unarnmous y. Haring ascertained this action to be the free act and deed of the Board the Planning Board Secretary notarized three copies each '`1elee of Covenant Agreement, Cushman Brownies Trust, Shellback Way, Mercantile way, Dots 19 and 20, Land Court Plan o-fir—F and - —F.
