The Chairman of the Zoning Board of Appeals feels that these requests are <br /> excessive and are a burden on the Board to conduct these hearings. After discussion with <br /> the Conservation Agent and review of the zoning bylaw, it was determined that the - <br /> foot dimensional requirement was to protect the marshland, but which could be varied by <br /> the Zoning.Board of Appeals. It was decided that every dock doe'not.require a Special <br /> Permit as they are reviewed by the Conservation Commission and the State for a permit. <br /> The Zoning Board of Appeals will continue to hear requests for a Special Permit for <br /> docks that cross wetlands in excess of 70-feet. <br /> The Town Planner informed the Board that all types of wetlands have been <br /> reviewed as described in both the Mate Statute wetlands Act and CMR Regulations and <br /> which areas of concern have been identified in the proposed Article, (coastal beach, <br /> coastal bank, salt marsh or bordering vegetated wetlands). <br /> Public Co n' ent <br /> The Chairman recognised Floyd Allen, who commented that a number of the <br /> docks being constructed include a bird watching platform, picnic platform, and dock <br /> space. He also stated concern for the possibility of docks over 7 -feet closing off <br /> portions of the channel. <br /> Lot Dine Front <br /> The Chairman explained that the existing bylaw defines-..Iot line front as "...a line. <br /> dividing a lot from a street..." The proposed Article will delete the word `street" and <br /> replace it with "laid out public or private way". <br /> Public Comment <br /> Hannah Schultz, stated her frontage is on Seconett Drive, which is a paper road. <br /> She asked if her road would be affected by the change. <br /> The Town Planner stated her property is along the shoreline of John's Pond and <br /> will now count a ,her front lot l ine. He also explained that this would have no affect on- <br /> Land Court plan . Them is a Land Court plan that has laid out a private moray called <br /> Seconetr Drive, which wi11 be considered the front lot line-under the proposed bylaw. <br /> Reorganization <br /> It was the general consensus of the Board to address this proposed Article at a <br /> later slate, after consulting with Town Counsel. <br /> Votes <br />
