1 ai
The Chairman called this matter to order and x e planned to
members of the public how the Plan was devised, the advantages
and disadvantages e es to the Town. H
 e explained that 1 f the Town
adopts the Plan and i it i s certified by the Cape cod
f
Commission, t would allow the Town to engage in Development #
Agreements and it wou 1 d empower the Town to charge impact fees.
He mentioned avinga Plan would help to guide the Town as it
develops and that within a two year( ) y period the Town should 1;
have revised its Bylaws to be in accordance with the Plan.
1 4
The Chairman explained the Plan is composed of sixteen (1 6)
components which have been many years in the making. The goal
for this Meetingis to settle • g
some final wording issues In order
that it be published f or dissemination and taken to Town Meeting Al.
at which time the Townspeople will vote upon it.
f=h
•'s
The Chairman recognized Selectman Nancy Caffyn, who inquired
about the impact fees. She stated it was her understanding that #
an approved Special Perm' • lsr
Y pp p Permit (Mashpee Commons, WZ 11 owbend, New
Seabury) would be exempt from any impact fees imposed under the
Local Comprehensive Plan.
The Chairman agreed that a Developer develops under the
original rules under which he/she was approved. He also stated `
negotiations could be made under a request for a modif ication of +
the Special Permit. He further stated it is his understanding
that the Mashpee Commons prof ect has agreed to be subj ect to
impact fees.
Selectman Caffyn stated she feels the impact fees are "very
good, " but she also noted there is very little left in Town to be
developed, rendering the impact fees somewhat questionable.
The Chairman responded,, "I differ with "
p you on that.
Mr. Fudala stated the impact fees could be implemented at .
various points in the development process, it could be at the
building permit 1 eve 1 rather than at the subdivision level.
> p
Selectman Caf fyn made the point that if the currently °l
approved Special Permits do not deviate from their Permits, the
Town would not be able to impose an impact fee. The Chairman
agreed this situation is possible. `
With reference to the Mashpee Commons project, Mr. Fudala
stated that the commercial portion of Mashpee Commons located
along Steeple Street up to the Library is exempt under the 1985
Special Permit. However, the new extension project mixed-use,
Job i s Fishing Road, Whitings Road, and East Steeple Street would
be subject to impact fees. r ,
' r
Job' s Fishing Road Extension t
Transportation Element Olga
-20-
;.
