JU <br /> I � <br /> MOTION: Fames Dorgan made a Motion to approve the Amendment <br /> to Rules and Regulations governing the Subdivision of Land, <br /> amendment to Section 12 Fee Schedule, change "Special Permit - <br /> Commercial" to "Special Permit - Non-Residential" ; which Motion ` <br /> was seconded b Dennis Bal <br /> Y zarznz and so voted unanimously. <br /> •`1 <br /> Covenant Release <br /> Lipnosky Family Trust-Ed Govoni - Three Pan ' <br /> Ponds Subdivision <br /> The Town Planner noted the lots listed on the Agenda for <br /> Release of Covenant are incorrect (#1 w-#11) ; there are however, <br /> eleven (11) Lots to be released. r <br /> The vice Chairman read into the Record letter dated <br /> September 16, 1998, to the Town of Mashpee Planning Board, from <br /> Charles L. Rowley, PE, RLS, Regarding Three Ponds Subdivision- <br /> Covenant Release: "Dear Chairman Coffey, I have inspected the <br /> construction of Preakness Land at the Three Ponds Subdivision off <br /> Pimlico Pond Road and find that the construction has not been � <br /> completed. The base course of pavement has been placed. Grass <br /> along the road shoulders if up and in good condition. Storm <br /> drainage has been completed along the road but there are some <br /> corrections that need to be made. At the entrance to Preakness <br /> Lane on Pimlico Pond road there is a catch basin which is much <br /> lower than the surrounding pavement. Instead of blending in the <br /> pavement on Preakness to the pavement on Pimlico Pond Road, the t <br /> existing 12" berm was left in place. This makes for a very <br /> abrupt transition in the road surface as well as a dangerous <br /> situation with h � <br /> the catch basin grate. the road intersection does <br /> not include the customary 20 ' radius at the edge of pavement. No <br /> street monumentation was observed and I have no letter indicating <br /> that bounds have been set. It is my recommendation that the <br /> request for release of lots should not be granted until a proper , <br /> form of security for the remainder of construction has been <br /> presented and approved by the Planning Board. I also notice that <br /> the request is for Lots 1-11 . Many of the lots requested do not <br /> front on Preakness Lane but front instead on Cove Road. A full {� <br /> inspection of this road has not been completed. " <br /> After brief discussion it was agreed upon by all Board ' <br /> Members to forward a copy of the Consulting Engineer' s letter to <br /> the Applicant, ask him to contact the Consulting Engineer <br /> directly for an further comment, and to continue this matter <br /> y to <br /> the October 7, 1998 Meeting. <br /> MOTION: Dennis Balzarini made a Motion to that effect, <br /> stating the Consulting Engineer' s letter is to be forwarded to <br /> theApplicant with instructions to contact the Consulting <br /> engineer directly for further comments, and to continue this <br /> matter to October 7, 1998; which Motion was seconded by Chance <br /> Reichel and so voted unanimously.
