is <br /> E <br /> Having acknowledged this action to have been the free act f ' <br /> and deed of the Planning Board, said Release of covenant was <br /> notarized by the Board Secretary. <br /> Definitive Plan <br /> Vivian Williams-Yankee Land Surveyors--Coombs Lane <br /> The Town Planner noted the file was accompanied by a request <br /> for waivers of Subdivision regulations. , <br /> lit, <br /> The Vice chairman announced said waivers were for lot size <br /> frontage requirement; definitive plan review fee- and inspection <br /> fee. <br /> P <br /> The Vice Chairman recognized a representative from Yankee ' <br /> Survey, who suggested this matter be defined as an ANR. <br /> The Town Planner explained that due to the lack of minimum <br /> frontage requirement; it is considered to be a Definitive Plan, , { f <br /> and therefor is required to go through the Definitive Plan <br /> process. <br /> References were made to a Plan entitled, "Division of Lots <br /> 8, 10, 12, and. 14-Located, in Mashpee, MA-Prepared for Vivian <br /> Williams-Dated November 2, 1998 . The Surveyor explained <br /> E <br /> three (3) lots were being created from the four (4) lots shown. . r <br /> The Town Planner confirmed that although variances have been <br /> granted from the Board of Appeals, Planning Board Subdivision <br /> Regulations require said lots to meet zoning requirements. <br /> Waivers for frontage and lot size requirements have been <br /> requested, as well as the preliminary plan process and fees for <br /> plan review and inspections. However, the Two Hundred ($200 . 00) <br /> Dollar filing fee would be applicable. <br /> Dennis Bal z arini stated he was in favor of granting the <br /> waiver for fees. <br /> i. <br /> MOTION: Chance Reichel made a Motion to accept the <br /> Definitive Plan, as presented by Applicant, identified as <br /> Assessor' s Map 44, Block 35-38, and to honor the request for <br /> waiver of applicable fees (definitive plan review-$345. 00 and <br /> inspection fee-$250 . 00) , zoning lot size and frontage <br /> requirements, as well as preliminary plan requirements, all as <br /> presented by Applicant this date; which Motion was seconded by { <br /> Dennis Balzarini and so voted unanimously <br /> After brief discussion, the Board requested Plans be <br /> resubmitted on regulation size 24 x 36 paper, delete "Approval R � <br /> Not Required" from plan, include the Town Clerk 20-day appeal <br /> period block, application and filing fee be submitted as soon as <br /> possible, and a Public Hearing in this matter be scheduled, ;. <br /> -3- <br /> s <br /> J r� <br /> f <br /> R i <br />
