PROCEDURAL HISTORY AND JURISDICTIONAL FINDINGS <br /> 1. An application for a so-called Comprehensive Permit and Amendment to an <br /> existing Comprehensive Permit was received by the Mashpee Zoning Board of <br /> Appeals (the "Board") on or about June 18, 2010 (the "Application"). The <br /> Application seeks to construct ten additional rental dwelling units in five new <br /> duplex buildings behind the existing six residential rental units(Breezy Acres I) <br /> that already exist on the Property. <br /> 2. Breezy Acres I was approved by a Comprehensive Permit that was filed with the <br /> Mashpee Town Clerk on August 13, 1987. A copy of the Breezy Acres I <br /> Comprehensive Permit is attached hereto. The Application includes requests for <br /> any necessary Amendment to the Breezy Acres I Comprehensive Permit. <br /> 3. By agreement, the Board's hearing on the Application was opened on August 4, <br /> 2010 and was continued to September 8, 2010. The hearing was closed on <br /> September 8, 2010. <br /> 4. The Applicant provided various plans, reports and memoranda during the public <br /> hearing on the Application. <br /> 5. The Board utilized the services of Special Counsel Jason Talerman, Esq. and <br /> Charles Rowley, P.E. to assist in the review of the Application. <br />
