MASHPEE ZONING BOARD OF APPEALS <br /> Mashpee Housing Authority and Housing Assistance Corporation <br /> Breezy Acres Phase II— 570 Old Barnstable Road <br /> Mashpee,MA 02649 <br /> CP-10-29 <br /> 7. The four additional parking spaces shown in the "shadow parking" area shall not <br /> be immediately constructed. However,parking may be reviewed by the Board no <br /> less than six months after the final occupancy permit is issued. If, after such <br /> review, it is determined by the Board that additional parking is required, the <br /> Applicant shall construct the "shadow"parking area. <br /> 8. The Final Site Plans shall include a construction mitigation plan that will address <br /> all aspects of construction mitigation(including erosion control, trucking routes, <br /> dust control, etc.) and sequencing. The Applicant shall, to the extent feasible, <br /> maintain as many mature trees as possible. <br /> 9. The Applicant shall utilize the Town's wastewater treatment system located at the <br /> High School. The Final Site Plans shall provide details for such connection. <br /> Nothing herein may be construed as governing or waiving any requirements or <br /> agreements for such connection. <br /> 10. Nothing herein may be construed as providing permission for a connection to a <br /> public water supply or sewer system. No building permits shall be issued until <br /> the Applicant provides the Board and Building Department with evidence that it <br /> possesses permission from the Town of Mashpee for a connection to the public <br /> water supply and sewer system. <br /> 11. The Final Site Plans shall contain a final design of the drainage system that <br /> exhibits compliance with all applicable best management practices and any <br /> applicable Stormwater Management Guidelines promulgated by the DEP or the <br /> Commonwealth of Massachusetts, as well as reasonable requirements that may be <br /> imposed by the Board, in consultation with its engineer and the DPW. The <br /> Massachusetts Stormwater Guidelines shall apply to the entire stormwater <br /> management system even if there are no wetland resource areas present. Should <br /> any requirements reasonably imposed by the Board's engineer result in a material <br /> change to any aspect of the Project, the Board's approval under 760 CMR <br /> 56.05(11) must be obtained. Additionally, an operation and maintenance plan for <br /> the stormwater system must be approved by the Board's engineer. <br /> 12. With respect to each of the Applicant's requests for waivers from local by-laws <br /> and regulations, the Board hereby decides as follows: <br /> 1. The Board approves waivers to dimensional and uses requirements in the <br /> Zoning Bylaws only to the extent necessary in order to build the Project <br /> that is shown on the Plans and approved Final Site Plans. <br /> 2. No waivers are granted from requirements that are beyond the purview of <br /> G.L. c. 40B, §§20-23. <br /> I. <br /> 3.
