The Town Planner stated the above Decision is to be filed <br /> with the Town clerk, (This matter concluded, at 7:45 p.m. ) <br /> special Permit <br /> Ron Bonvie-Southport Retirement community-Update <br /> f <br /> The Assistant Town Planner informed the Board of the <br /> cancellation of this matter by request of the Applicant. <br /> Approval Not Required <br /> i <br /> Chet Hughes-coastal Engineering-Signature 5-Lot ANR Plan <br /> The Chairman determined there was no one present at the <br /> Meeting to present said ANR Plan. <br /> 'f <br /> Approval Not Required <br /> Tremont at Union Limited Partnership-Douglas Lebel <br /> The chairman recognized Mr. Lebel, who identified himself <br /> for the Record as Doug Lebel, Tremont at Union Limited <br /> Partnership, who presented a 3-Lot ANR Plan, located. off Great � <br /> Oak Road, consisting of Lots 1, 3, and 4 . said Plan of Land ., <br /> entitled, Plan of Land. in Mashpee, MA, prepared for Tremont at <br /> Union Limited Partnership, dated November 12, 1997 . Mr. Lebel <br /> noted that Lot 2, as indicated on said Plan, is identified as an <br /> "unbuildable lot . " Mr. Lebel identified the location of this <br /> land to be in the middle of the Bufflehead Bay area; and <br /> further explained said land to have been excluded from Land <br /> Court. E <br /> The Town Planner raised the question of rightful. ownership <br /> r <br /> of said property. He informed the Board that Town counsel has <br /> not verified clear ownership. The Town had been in the process <br /> of recovering said land for hack taxes, at which point the <br /> Partnership filed to redeem said property from Land Court, who <br /> determined they did not possess the ability to register the 71 <br /> title, however they did posses enough interest in it to redeem <br /> the property. As a result, the back taxes have been paid. There '} <br /> is a Deed from a certain party that may or may not have ever <br /> owned said property. <br /> Mr. Lebel stated the property is insured by a Title Company <br /> (old Republic Title) , which is the same company that insured it <br /> for the taking. They have insured both the surrounding land and <br /> the parcel under discussion. Mr. Lebel was in agreement with <br /> statements made by the Town Planner, explaining the land has <br /> undergone a complicated Land Court proceeding. <br /> The Chairman requested clarification of the three (3) year <br /> protection issue, and was told it is for "Use Only The Town <br /> Planner stated the land to be currently zoned for residential use <br /> and will remain so for the next three (3) years. zoning changes are not anticipated. -9- <br />
