0 Mashpee Zoning Minutes <br />Board of Appeals December 9, 2009 <br />Mr. Biemer addressed the Board. He said that he has owned the subject home for <br />15 years and that it is a basic "Cape" with electric heat. He is seeking setback <br />relief in order to allow for expansion of the home and improvement of the <br />property. He said that the proposed addition is appropriate to the property. Mr. <br />Blaisdell reviewed the plans and referred to the little `jog' on the plan. He asked <br />for the exact amount of Variance being requested. Mr. Biemer answered that the <br />jog is a proposed chimney and that he is seeking a 3.6 foot variance. He said that <br />the home is within only a few feet of being centrally located on the lot. Mr. <br />Nelson commented that there is adequate parking on the property. He also <br />remarked that lot coverage is at 20%, something seldom seen in Popponesset. <br />Adjacent abutting neighbors Mark and Deborah Lavoie wrote a letter to the Board <br />which stated: "We respectfully ask that the Board take note that we do not object to <br />the Biemer's Petition and proposed plan". <br />Mr. Blaisdell made a motion to grant a Variance of 3.6 feet from the side setback <br />requirements. Mr. Furbush seconded. All were in favor. This is conditioned upon <br />compliance with Cape & Islands Engineering Plan entitled: "Uncle Henry's Rd., <br />Plot Plan of Land Located in Mashpee, Mass., Prepared for Robert Biemer, Date: <br />Oct. 22, 2009. Scale: 1 "=20', Cape & Islands Engineering, Mashpee Mass. David <br />Charles Sanicki, 28085, Registered Professional Land Surveyor, Commonwealth <br />of Massachusetts". <br />Jeremy N. Stevenson: Request a Special Permit from 174-17, 174-20, 174-24C, <br />and if applicable 174-58 and 174-59 of the Zoning By-laws to raze and replace a <br />single-family residence located at 431 Monomoscoy Road (Map 124, Parcel 53) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, William Blaisdell and Peter Hinden. <br />Attorney Kevin Kirrane, Engineer John Slavinsky of Cape & Islands Engineering <br />and Architect Thomas J. O'Neill represented the applicant. Attorney Kirrane <br />submitted photos of the lot for the Board to review. He said that the subject <br />property is a pre-existing non -conforming lot with 19,425 square feet of upland <br />area. Taking into account all Westland Resource Areas, it is assessed as a one -acre <br />lot with 40 -foot frontage on Monomoscoy Road. There is a single -story dwelling <br />serviced by a cesspool, as well as a dock and shed, currently existing on the lot. <br />Attorney Kirrane stated that the proposal is not substantially more detrimental and <br />3 <br />
