Mashpee Zoning Mashpee Commons Limited Partnership 2 <br /> Board of Appeals V-03-32 <br /> J <br /> Mr. Douglas Storrs, Vice President of Mashpee Commons Limited Partnership, <br /> represented the applicant's request for a Modification to an Existing Special Permit. <br /> Condition#5 of the Special Permit, SP-86-04-024, as previously modified, requires the <br /> applicant to request and receive consent from the Zoning Board of Appeals for any <br /> revisions to the original Special Permit and a Variance. The applicant is petitioning the <br /> Board to re-locate the current post office that resides in building#14 to a new building <br /> they are proposing to build and will refer to as building#22 and needs setback relief and <br /> parking relief. The new building will consist of the post office and some retail and office <br /> space The Building requires 48 parking spots and applicant is presenting 57 spaces. The <br /> Board discusses parking problems that exist at the current post office and how difficult it <br /> is to access that building, especially for handicapped people. Mr. Storrs informs the <br /> Board that the post office will mail boxes will remain open until 11:00 pm for the <br /> convenience of the town. Mr. Storrs also tells them that the retail will be something <br /> softer than William Sonoma. Most deliveries will occur before 7:00 a.m. Two <br /> handicapped spaces must be done within 300 feet of the front door. Mr. Storrs will <br /> dedicate a third van accessible spot as well. This new post office will greatly benefit the <br /> Town of Mashpee since Mashpee has grown exponentially. After some further <br /> discussion, Jonathan Furbush makes a motion to grant a 5.6 foot variance and a variance <br /> for the parking. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 38 Nathan Ellis Highway and consists of <br /> 40.3 acres of land. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that relief play be granted without detriment to the public good. <br />
