Mashpee Zoning <br />Board of Appeals Minutes <br />• 3 March 12, 2008 <br />Greoory & Elizabeth Stento, Trustees of 155 Pouoonesset Island Road: <br />Requests a Special Permit from Sections 174-17, 174-20, 174-24C, 174-59 and <br />174-63 of the Zoning By-laws in order to raze and replace a single family <br />residential structure on this non -conforming parcel on property located in an R-3 <br />Zoning District at 155 Popponesset Island Road (Map 112 Parcel 13) Mashpee, <br />MA. <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, William <br />Blaisdell and Peter Hinden. <br />Attorney Kevin Kirrane from Dunning & Kirrane represents the applicants at this <br />hearing. They are seeking a special permit in order to raze and replace the <br />existing structure located on a non -conforming lot. The applicant must prove the <br />new dwelling is not more detrimental than the existing dwelling. The new <br />dwelling will remain at four bedrooms and the setbacks will be more conforming. <br />There will be no habitable space below the flood plane.• Mr. Nelson mentions <br />there is a discrepancy on the lot coverage and that the actual lot coverage will <br />be at 19.3%. The Board discusses the turf and Attorney Kirrane mentions the <br />rain gardens and that the Conservation Commission has agreed to what is best <br />for the project. Jonathan Furbush makes a motion to grant the Special Permit <br />with the following conditions: <br />. • Approval from Conservation Commission on the Talbot Plan dated 2/1/08. <br />Michael Talbot's landscaping plan stamped with Cape & Islands dated <br />January 12, 2008 revised January 25, 2008, revised February 1, 2008 <br />Plans from John Dvorsack of Falmouth, MA, dated 11/16/07. <br />James Reiffarth seconds the motion. All agree. So moved. Plans referenced <br />above are conditioned on this permit. <br />Timothv Kellev: Requests a Special Permit from Sections 174-24 C (1); 174-25 <br />G (4); 174-25 (6) and 174-25 (9) in order to build a contractor and wholesale <br />business with storage in 4 detached buildings on property located in an I-1 <br />zoning district at 52 Mercantile Way (Map 88 Parcel 85) Mashpee, MA. Owner <br />of Record: Shirlev M. Ropers of Naoles. Florida <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Jack Dorsey and <br />Willliam Blaisdell. <br />Attorney Brian Garner represents Timothy Kelley at this hearing. They are <br />seeking a Special Permit for a commercially zoned lot (4 separate buildings) for <br />• use as contractor bays with wholesale business and storage with 4 detached <br />buildings.
