5. The Project will be accessed by a single, lengthy dead-end private driveway that <br /> bisects the Property and terminates in a cul-de-sac. The driveway has a proposed <br /> travel width of twenty(20') feet. Additionally, there are visitor spaces along the <br /> Project driveway. <br /> 6. Adjacent to the Property is another undeveloped tract that is not part of the <br /> Application. An easement for possible future connections is indicated on the Plan <br /> but nothing in the Application or this decision sets forth a proposal or approval for <br /> such connection. <br /> 7. The Applicant proposes stormwater management facilities that include a <br /> relatively novel bio-retention system. Initial review by the Board's consultant <br /> indicated that the stormwater management system is feasible but that, as <br /> recognized by the Applicant's consultant, careful attention must be paid to <br /> maintenance of the system. <br /> 8. The Applicant proposes a public water source via the Mashpee Water District, <br /> over which the Board has no jurisdiction. <br /> 9. The Project will be served by a private shared septic system over which the Board <br /> has no jurisdiction. The Applicant is pursuing so-called"nitrogen credits" which <br /> would enable it to expand the Project's 1-bedroom house to a 2-bedroom house. <br /> 10. The Plans show an attached garage for each house, with the exception of"lot" 8 <br /> which would have a garage within the house footprint. <br /> 11. The Applicant has submitted a limited list of requested waivers, as most recently <br /> revised on June 26, 2007, from local by-laws and regulations. A discussion of <br /> waiver requests is included in Sections III and IV hereof. <br /> III. FINDINGS <br /> 1. The Board finds that the Town has a continuing need for affordable housing and <br /> that this project will provide such housing. The Board also finds that, due to the <br /> modest design of the Project, the market rate units will also be affordable to <br /> middle income Cape residents. The Board therefore finds that an approval may <br /> be warranted despite the fact that recent progress toward the creation of affordable <br /> housing may entitle the Board to reject the Application. <br /> 2. The Board finds that the single means of access/egress poses some risk with <br /> respect to emergency vehicle response. However, the Board finds that the <br /> relatively modest length of the roadway and the low density of the project <br /> minimize this risk. Nevertheless, the Board finds that any future extension of this <br /> roadway may cause an unacceptable safety hazard that may not be approvable by <br /> the Board. <br /> Southside 11-final permit 3 <br />
