The Applicant possesses an interest in the site by virtue of the fact that it has <br /> entered into a purchase and sale agreement with the current owner 340/342 Main <br /> Street, LLC, which is a substantially related entity. <br /> 5. A public hearing timely commenced on March 29, 2007 and was continued, with <br /> good cause to the following dates: April 11, 2007, May 3, 2007, June 13, 2007 <br /> and June 26, 2007. On June 26, 2007, the hearing was closed. There was an <br /> extension granted by the Applicant of the time to file the decision, to August 17, <br /> 2007. <br /> 6. The Board utilized the services of Special Counsel Jason Talerman and the <br /> engineering firm of Charles L. Rowley &Associates to assist in the review of the <br /> Application. Town officials, including the Chief and Deputy Chief of the <br /> Mashpee Fire Department also contributed a significant amount of information <br /> and analysis. <br /> 7. The Applicant was represented by Attorney Kevin Kirrane and the Applicant's <br /> principal John McShane was present at the hearing. The Applicant was also <br /> represented by the Horsley Witten Group with respect to engineering issues. The <br /> Applicant's Architect is Steven C. Hayes. <br /> 8. Throughout the hearing, the Applicant responded to the Board's concerns by <br /> revising the plans and providing additional materials. <br /> II. PROJECT AND PROPERTY DESCRIPTION <br /> 1. The project configuration is described in: the Application, the architectural plans <br /> and the various site plans of the Horsley Witten Group. For the purposes of <br /> determining the project configuration approved by this decision, the Horsley <br /> Witten Group plans as revised through June 15, 2007 and entitled <br /> "Comprehensive Permit Application, Main Street Village Residential, Mashpee <br /> Massachusetts," shall be the plans of record and shall be hereinafter referred to as <br /> the "Plans." The Plans shall include architectural plans of the Steven C. Hayes. <br /> 2. The Property is in the C-2 and R-5 Zoning Districts and contains approximately <br /> 2.33 acres. The Property is currently undeveloped and is immediately adjacent to <br /> Phase I of Main Street Village, which has yet to be fully completed. <br /> 3. The Project contemplates eight single family homes, seven of which will have <br /> two-bedrooms apiece. Due to septic restrictions, the eighth home will have only <br /> one bedroom. Two of the 2-bedroom homes are to be restricted for sale to low or <br /> moderate income households. <br /> 4.
