Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on June 22, 2007 and June <br /> 29, 2007 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was schedule for July 11, 2007 and was continued and held on <br /> the Petition at the Mashpee Town Hall on Wednesday, August 8, 2007, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert G. Nelson, Zella Elizenberry, Jonathan Furbush, Jamse Reiffarth and George <br /> Bolton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Peter Merlino represents himself at this hearing. They are seeking a variance in <br /> order to extend their existing pier beyond the 70 feet that is allowed under the current <br /> zoning. They are seeking a 29 foot variance. They have been approved by Conservation <br /> the Board notes that the water is very shallow over there. There are no comments from <br /> Shell fish or Harbormaster. Zella Elizenberry moves to grant a 29 foot variance to the <br /> existing pier. Robert Nelson seconds the motion. All agree. So moved. <br />
