Vown of Mashpec <br /> N <br /> 16 Great Neck !�oa.d Xorth <br /> MASHPEE ZONING BOARD OF APPEAL <br /> $'Iash,peE, Massachusctts 02649 <br /> Decision for a Variance <br /> RE: Peter Merlino 18 Quaker Run Road <br /> Map 83 Parcel 212 <br /> V-07-45 <br /> A Petition was filed on June 15, 2007 for a Variance under Section 174-25(l)(9) <br /> of the Zoning By-laws to extend the existing pier and ramp beyond the allowable 70 feet <br /> from mean high water on property located in an R-3 zoning district at 18 Quaker Run <br /> Road (Map 83 Parcel 212) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on June 22, 2007 and June <br /> 29, 2007 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was schedule for July 11, 2007 and was continued and held on <br /> the Petition at the Mashpee Town Hall on Wednesday, August 8, 2007, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert G. Nelson, Zella Elizenberry, Jonathan Furbush, Jamse Reiffarth and George <br /> Bolton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Peter Merlino represents himself at this hearing. They are seeking a variance in <br /> order to extend their existing pier beyond the 70 feet that is allowed under the current <br /> zoning. They are seeking a 29 foot variance. They have been approved by Conservation <br /> the Board notes that the water is very shallow over there. There are no comments from <br /> Shell fish or Harbormaster. Zella Elizenberry moves to grant a 29 foot variance to the <br /> existing pier. Robert Nelson seconds the motion. All agree. So moved. <br />
