Similarly, after completion of the project,the Jobs and Whiting Homeowner's <br /> Association shall retain a Neighborhood Architect on an as-needed basis to oversee modifications <br /> to structures and otherwise perform the functions hereunder. Any change in the Neighborhood. <br /> Architect by the Homeowner's Association requires the Zoning Board's prior approval, such <br /> approval not to be unreasonably withheld. The Trust, any successor project proponent and/or the <br /> Homeowner's Association shall promptly remove and replace the Neighborhood Architect if said <br /> architect is not fulfilling his duties nuclei-the Rules, the Code or the Comprehensive Permit. <br /> The Office of the Neighborhood Architect will be available to assist you as you go through the <br /> design approval process. By meeting with the Neighborhood Architect early in the process,the <br /> applicant can receive valuable suggestions that help avoid costly changes later. <br /> The Office of the Neighborhood Architect meets as necessary. The applicant shotild check with <br /> the Neighborhood Architect's Office to request a meeting with the Neighborhood Architect and <br /> to get the cutoff date and other applicable,procedures for applications. Applicants must submit <br /> two (2) complete sets of plans and applications by the cutoff date to give the staff time for review. <br /> An additional set of Plans must also be submitted to both the Mashpee Building Inspector and the <br /> Mashpee Zoning Board of Appeals. You and your architect do not need to appear at the meeting <br /> during which your application will be reviewed. <br /> SubMit t1V0 (2) copies of all regztii°ed documents and draivings to: <br /> .Jobs and TV17itings Neighborhood, Attention. Office of the Neighborhood Architect, at. <br /> xxxxxx, Massachusetts xxa:xx <br /> All documents shall include the name "Jobs and Whitings Neighborhood," lot number, lot street <br /> address, building type, owners'names, and the date. <br /> As further described in these materials,there are several stages of review ai d approval At each <br /> stage,an application can be approved, approved with stipulations and conditions, or denied. Tile <br /> Office of the Neighborhood Architect will make every effort to notify the applicant of its decision <br /> in a reasonable time.However, a delay in reviewing an application shall not be deemed consent to <br /> construction. All decisions of the Neighborhood Architect are binding upon the applicant. There <br /> is no appellate process for unfavorable decisions although reapplication is permitted. Denials and <br /> conditional approvals shall contain a written statement by the Neighborhood Architect explaining <br /> the rationale for such decision. In reapplying, an Applicant should address each reason set forth <br /> by the neighborhood Architect, preferably with plan modifications. <br /> 17OUR RESPONSIBILITIES <br /> The Applicant is responsible for ensuring that Construction Conforms to all Massachusetts <br /> building codes, applicable local bylaws and regulations, and other governmental approvals, laws <br /> and regulations. In addition, all owners of buildings within Jobs and Whitings' are encouraged to <br /> comply with the standards established by two voluntary building codes: the Sustainability . <br /> Guidelines established by the Greeii Building Coalition,Inc. for environmentally sensitive design. <br /> and practice, and the Fortified Home Guidelines established by the Institute for Business &Home <br /> Safety(IBHS)to provide disaster-resistant features. Both of these guidelines have been adopted <br /> as part of the Jobs and Whitings Design Code. Each of these codes is subject to amendment or <br /> 2 <br />
