Current copies of these <br /> two codes, along with such other applicable codes as may be duly approved, shall be available at <br /> the Office of the Neighborhood Architect. <br /> If the Office of the Neighborhood Architect notes noncompl iance with any bu ilding code, other <br /> governmental regulations, or the Sustainability or Fortified Home Guidelines, you may be <br /> required to make the necessary changes. <br /> Although the developer of the Jobs and.Whitings Neighborhoods and the Office of the <br /> Neighborhood Architect are concerned primarily with aesthetic considerations, another one of the <br /> primary goals is to also review the submitted applications in order to determine whether the <br /> proposed construction conforms to this Code. <br /> The developer of the Jobs and Whitings Neighborhood and the Office of the Neighborhood <br /> Architect, as well as the Homeowner's Association does not assume responsibility for the <br /> following: <br /> • The structural adequacy, capacity; or safety features of the structure or any improvement <br /> of the structure <br /> • Non-compatible or.unstable soil conditions, soil erosion, etc. <br /> • Compliance with any or all building codes, safety requirements, and governmental laws, <br /> regulations, or ordinances. . <br /> • The performance or quality of work of any architect, engineer, or contractor. <br /> - Your lot(s) has been sold to you with the requirement tliat you finish your homes) within a <br /> specified time as described in your purchase and sale contract. Because you.and your neighbors <br /> may be building at approximately the same time, you will become part of a neighborhood sooner. <br /> However,this restriction means that you will have to pay close attention to the recommended <br /> time limits.For example, if your unit(s) must be built within two years,the following deadlines <br /> are recommended: <br /> • -Sketch Review within ten(10) months after closing <br /> • Schematic Design Re-view no later than twelve(12)_months after closing <br /> • Construction Documents Review no later than fourteen.(14) months after closing. <br /> As design and constriction invariably take longer than you think,try to give yourself plenty of <br /> time to meet the deadlines. Make sure your applications are complete, with all required materials, <br /> as an incomplete application may be rejected and delay the process. The various steps of the <br /> design approval process are intended to guide you at each critical stage. The remainder of this <br /> text outlines the steps you will need to follow. <br /> Finally, it is noteworthy that construction in the Jobs & Whiting neighborhood is governed by a <br /> variety of different permits, approvals, agreements and other documents that may limit or restrict <br /> certain forms of development. Each such document should be carefully reviewed before <br /> proceedings with development. Most particularly,the Jobs &Whiting Neighborhood is governed <br /> by the underlying Comprehensive Permit issued by the Mashpee Zoning Board of Appeals. it is <br /> the Applicant's responsibility to ensure that all submitted plans and designs strictly comply with <br /> the Comprehensive Permit and the Plans approved thereunder. While such permit allows for <br /> significant deference to the flexibility that is inherent in the Rules and the Code, any direct <br /> conflict between the Rules or the Code and the Comprehensive Permit must be resolved in favor <br /> r <br /> of the Permit. These Rules and the Code constitute are incorporated into the Comprehensive <br /> Permit and may be enforced by the I\7ashpee Zoning Board under 760 CMR 31.09(4) and <br /> J <br />
