If no written <br /> response or comments have been given to the Applicant by the Board <br /> concerning the Final Site Plans within forty-five days after the Final Site Plan <br /> Submission Date, the Final Site Plans, as delivered, will be deemed to have been <br /> approved. Nothing herein shall be construed to limit or otherwise affect the <br /> Mashpee Building Department's authority and obligations under the State <br /> Building Code. <br /> 3. In addition to all customary final site and design plans, the Final Site Plans shall <br /> include a lighting plan that ensures proper lighting while mitigating, to the <br /> maximum extent possible, any "light spill" onto neighboring properties. A <br /> narrative describing the type of lighting and the proposed lighting schedule shall <br /> also be provided. <br /> 4. The Final Site Plans shall indicate final dumpster locations. Dumpsters shall be <br /> shielded by an 8' high stockade (or equivalent) fence. Trash-pick up shall be <br /> scheduled for at least two times per week, as may be more frilly described in the <br /> management contract for the Project. The Applicant shall provide for recycling <br /> of paper, cardboard, bottles, cans and other standard recycle-able items. <br /> 5. The Final Site Plans shall include a final landscaping plan. All plantings shall <br /> be guaranteed for at least two years. Only environmentally friendly landscaping <br /> products and fertilizers may be used. As agreed, the Applicant (via Mr. Edward <br /> A. Fish) shall donate the amount of$25,000.00 to the Sea Oaks Condominium <br /> Association for the purpose of enhancing the proposed vegetated buffer between <br /> the two properties. The Board shall be provided with evidence of such donation <br /> but shall not otherwise have any role in the expenditure of such fiords. <br /> 6. As to the Project's vegetated buffer as shown on the revised Plans, the <br /> Applicant shall install stakes and flagging every 15 feet or "snow fencing" to <br /> demarcate the buffer and the limits of clearing so as to ensure the health of the <br /> natural plantings in the buffer. The stakes or snow fencing must be installed by <br /> a registered land surveyor and must be inspected and approved by the Building <br /> Inspector prior to the commencement of construction. Notwithstanding the � <br /> continuous buffer shown on the Plans, the landscaping plans contained with <br /> Final Site Plans shall provide for clearing and landscaping of the buffer area <br /> between the two Project entrances along Carleton Drive (as authorized by the <br /> Board of Selectmen). This decision shall act as a continuing restriction against <br /> any further clearing of the designated vegetated buffer. <br /> 7. The Final Site Plans shall show 57 parking spaces, rather than the proposed 56 <br /> spaces, with the one additional space being designated for managerial staff. The <br /> Final Site Plans shall also include so-called "shadow parking"— i.e. area(s) that <br /> could support the construction of at least twenty additional spaces.
