Maslipee Zoning <br /> Board of Appeals EA Fish Asher's Path, LLC <br /> 7 Comprehensive Permit Chapter 40 B <br /> SP-06-47 <br /> Board, describing the amount of cars kept by on the Property by residents as well <br /> as the average amount of parking spaces needed to accommodate staff and <br /> visitors. Upon receipt of this report, if the Board finds that the proposed 56 <br /> parking spaces are insufficient to meet the Project's parking demands, the <br /> Applicant shall construct some or all of the additional twenty spaces, as may be <br /> ordered by the Board. <br /> 8. Nothing herein may be construed as providing permission for a connection to a <br /> public water supply. No building permits shall be issued until the Applicant <br /> provides the Board with evidence that it possesses permission from the Mashpee <br /> Water District for a connection to the public water supply. <br /> 9. No occupancy permits shall'be issued until the Applicant provides the Board with <br /> proof that it has obtained any and all State and/or local permits for construction of <br /> the Project's wastewater treatment facilities. <br /> 10. The Final Site Plans shall contain a final design of the drainage system that <br /> exhibits compliance with all applicable best management practices and any <br /> applicable Stormwater Management Guidelines promulgated by the <br /> Commonwealth of Massachusetts, as well as reasonable requirements that may be <br /> imposed by the Board's engineer. The Massachusetts Stormwater Guidelines <br /> shall apply to the entire stormwater management system even if there are no <br /> wetland resource areas present. The Applicant shall also comply with all <br /> recommendations set forth in the memorandum of Charles Rowley, dated July 25, <br /> 2006, unless the Board or the Board's engineer (presently Mr. Rowley) authorizes <br /> a deviation from the terms of such memo. Additionally, a final operation and <br /> maintenance plan for the stormwater system shall be submitted along with the <br /> Filial Site Plans, for the review and approval of the Board's engineer. <br /> 11. Except as may be otherwise conditioned hereby, the Board hereby grants all <br /> waivers from local regulations and by-laws that are necessary to construct the <br /> project, as shown on the Plans and as may be shown on the approved Final Site <br /> Plans. Waivers are limited to the extent necessary to construct the project shown <br /> on the Plans and the approved Final Site Plans. Waivers are further limited solely <br /> to the by-laws and regulations contemplated under G.L. c. 40B, §§20-23. No <br /> other waivers are granted and all local by-laws and regulations not waived shall <br /> be enforced in their entirety. There shall be no waiver of permit or inspectional <br /> fees. Waivers as to height restrictions shall be limited such that the maximum <br /> permitted height of the building shall be 40'. Requirements for installation of <br /> property bounds are waived with the exception that concrete property bounds <br /> shall be placed at each end of the Property line (said Property line being shown <br /> as 642.23' on the Plans) that is adjacent to the Sea Oaks condominium property <br /> and other adjacent properties immediately to the east. Any subsequent revision <br /> to the Plans that requires additional or more expansive waivers of any local by- <br /> laws or regulations must be approved by the Board in accordance with 760 CMR <br /> 31.03. <br />
