Zoning Board <br />Of Appeals Minutes <br />• 5 February 2, 2005 <br />and expansion of anon -conforming structure and lot on property located in a R-3 zoning <br />district at 2 Pine Avenue (Map 123 Parcel 34) Mashpee, MA. <br />Nicholas A. Ruocco Jr. Trust, Four Sons Realtv Trust: Request a Variance from <br />Section 174-31 of the Zoning By-laws seeking relief from the setback requirements and. <br />landspace requirements to build a new dwelling on property located in a R-3 zoning <br />district at 2 Pine Avenue (Map 123 Parcel 34) Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry Frederick Borgeson and <br />.Jonathan Furbush. <br />John Slavinsky of Cape & Islands Engineering represents the petitioners at this hearing. <br />They are seeking a special permit in order to demolish the existing dwelling and for <br />expansion of a non -conforming lot and for several variances since they cannot meet the <br />current setback requirements. Mr. Slavinsky informs the board that this is a corner lot <br />and the new dwelling will actually be less non -conforming than what exists and a new <br />septic system will be installed. Kathy Rosenfeld, wife of applicant submits many letters <br />in support of this project. However, Mr. Nelson reads a letter in opposition from Mr. <br />Sockbeson who resides at 3 Pine Ave. He feels granting of any variance will negatively <br />impact his property and the surrounding properties and feels that the proposed dwelling <br />will exacerbate the drainage problem. The Board reviews the comments and discusses <br />them with Mr. Slavinsky. Mr. Ruocco speaks about the drainage matter. This was <br />apparently discussed year after year in the Association Meetings and they are aware of <br />the situation and will be attending to the issue at some point soon. The Board would like <br />to impose that dry wells be added to the house for additional solution to any drainage <br />problems they may have. Frederick Borgeson makes a motion to grant the special permit. <br />Robert Nelson seconds the motion. All agree. So moved. Frederick Borgeson makes a <br />motion to grant the following: <br />✓ A 33,239 square foot landspace variance <br />✓ A 19.5 foot variance from the front yard setback <br />✓ A 4.5 foot variance on the side yard <br />✓ A 4.5 foot variance on the side yard <br />Robert Nelson seconds the motion. All agree. So moved. Reference plans from Cape & <br />Islands Engineering, dated January 6, 2005, plan no. 010605, file No. 125MA. <br />James Ouielev: Requests a Variance from Section 174-31 of the Zoning By-laws <br />seeking relief from the landspace requirements in order to build a new house on property <br />located in an R-3 zoning district at 130 Summersea Road (Map 105 Parcel 55) Mashpee; <br />MA. <br />Sitting: James Regan, Robert Nelson; Zella Elizenberry, Frederick Borgeson and Evano <br />• Cunha. <br />
