Zoning Board <br />Of Appeals Minutes <br />• 6 February 2, 2005 <br />John Slavinsky of Cape & Islands Engineering represents the petitioner. He is seeking a <br />variance from the setback requirements and landspace requirements in order to demolish <br />and rebuild a three-bedroom house. They will be installing a new denitrification system <br />for the septic and Con Comm. has approved the project. Zella Elizenberry moves to <br />grant the following: <br />✓ A 3.2 foot variance on the southerly side <br />✓ A 5 foot variance on the northerly side <br />✓ An 18.2 foot variance from Sumersea Road <br />Robert Nelson seconds the motion. All agree. So moved. Reference plans from Cape & <br />Islands Engineering, dated January 5, 2005, file no. 115MA. <br />Richard Furlani: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the 20% maximum lot coverage to build a handicapped accessible <br />addition on property located in an R-3 zoning district at 35 Bayview Road (Map 119 <br />Parcel 129) Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry, Jonathan Furbush and Frederick <br />Borgeson. <br />• Richard Furlani represents himself at this hearing. He is seeking a lot coverage variance <br />order to build 2 handicapped bedrooms and a handicapped bathroom. He has two <br />daughters with Sanfiillipo disease and they would like to build this for them to keep them <br />out of a mirsing home. Thcy will both be wheelchair bound very shortly and this addition <br />would put them over the 20% maximum that the Board generally imposes on new <br />dwellings. The Board feels that since this is a medical necessity and special circumstance <br />that they will grant the 4.2% lot coverage variance. Jonathan Furbush moves to grant a <br />4.2% lot coverage variance. Zella Elizenberry seconds the motion. All agree. So moved. <br />Reference plans from Cape & Islands Engineering, dated December 7, 2004, file no. 143 <br />MA, plan no. 120704. <br />Patrick Mone: Requests a Variance from Section 174-31 of the Zoning By-laws seeking <br />relief from the setback requirements and lot coverage requirements on property located in <br />an R-3 zoning district at 20 Sand Dollar Lane (Map 105 Parcel 80) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Evano Cunha and Frederick Borgeson and <br />Jonathan Furbush. <br />Jennifer Mone represents herself at this hearing. She is seeking a sideyard variance in <br />order to put an addition onto her house. Their lot is 8,047 square feet and their current <br />house is only 876 square feet. They would like to add on an addition consisting of 562 <br />square feet and cannot meet the setback requirements of 15 feet. They need a 2.5 -foot <br />sideyard variance. Mr. Regan mentions how burdensome this is for the applicant for only <br />• 2 feet. Zella Elizenberry moves to grant a 2.5 -foot variance on the southerly -side. Robert <br />
