• <br />0 <br />Zoning Board <br />Of Appeals Minutes <br />7 February <br />Nelson seconds the motion. All agree. So moved. <br />Reference plans from Ferreira <br />Associates, dated December 1, 1004, as prepared for Patrick Mone. <br />James Archibald: Requests a Variance from Section 174-31 of the Zoning By -lays <br />seeking relief from the setback requirements to build a master bedroom on property <br />located in an R-3 zoning district at 422 Cotuit-Sandwich Road (Map 22 Parcel 44) <br />Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry, Frederick Borgeson, and <br />.Jonathan Furbush. <br />Mr. Archibald along with his builder.Nick Lagadinos represent themselves at this <br />hearing. They are seeking a variance in order to build a master bedroom. Since the <br />zoning has changed they are unable to meet the 25 -foot setback requirement. Frederick <br />Borgeson moves to grant an 8.1 -foot variance on the northerly side. Zella Elizenberry <br />seconds the motion. All agree. So moved. Reference plans from Yankee Survey <br />Consultants dated December 11, 2004. <br />Other Business: <br />❑ Zella Elizenberry moves to accept the minutes from January 12, 2005 and January <br />26, 2005. Jonathan Furbush seconds the motion. All agree. So moved. <br />❑ Robert Nelson discusses the articles that they are attempting to put on the warrant <br />for the May Town Meeting. Section 174-91 currently exists in such a manner that <br />would be difficult for the ZBA at the moment. They would like to have their <br />terms last three years not five years having one expiring on an annual basis. The <br />next article seeks to amend section 174-24C(9) currently exists incorrectly. Since <br />the ZBA went to a 5 person board, if must have 4 favorable votes to pass a motion <br />not the majority as it reads now. The next article deals with section 174-92 by <br />adding that they would like to elect a Vice -Chairman legally. They have had a <br />Vice -Chairman for a number of years and would like to remain that way but be <br />sure to do it legally. <br />❑ James Regan states that tonight will be his last meeting as he is retiring as <br />Chairman from the ZBA. He will submit a letter of resignation to the Board of <br />Selectmen as soon as possible. The Board congratulates him on his long term and <br />will be sorry to see him go. <br />Richard Guerrera makes a motion to adjourn. Zella Elizenberry seconds the motion. <br />All agree.
