_k <br />• <br />• <br />• <br />Mashpee Zoning <br />Board of Appeals Minutes <br />3 February 9, 2005 <br />3 additions to the existing dwelling on property located in an R-3 zoning district at 67 <br />Popponesett Island Road (Map 106-9 Parcel 279) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Richard Guerrerra, Frederick Borgeson, Evano <br />Cunha and Jonathan Furbush. <br />Jack Landers-Cauley, Engineer, represents the petitioners. They are seeking a variance <br />for setback requirements and lot coverage requirements. The Board informs them that <br />they will not entertain the idea of 26.2% lot coverage under these circumstances and tells <br />petitioners to scale the house back. Mr. Landers Cauley is aware of the 20% maximum <br />and will redesign the house accordingly. He informs the Board that Mrs. Papparella's <br />sister is going to be living with them and therefore they are seeking to enlarge the floor <br />plans of the house for her on the first floor so that stairs will not become a problem for <br />her.' Mr. Nelson mentions the 48' foot addition could be scaled down and so could the <br />deck. They would be willing to discuss setback variances if they reduce the house size. <br />Petitioner asks for a continuance until the next available hearing. The Board moves to <br />grant a continuance until February 23, 2005. All agree. So moved. <br />Melinda Bradlev Trust, The Grump Trust: Requests a Variance from Section 174-34 <br />of the Zoning by-laws seeking relief from the 150' setback to a cranberry bog on property <br />located in an R-3 zoning district at 14 Cranberry Lane (Map 23 Parcel 208) Mashpee, <br />MA. <br />Melinda Bradlev Trust. The Grump Trust: Requests a Variance from Section 174-34 <br />of the Zoning by-laws seeking relief from the 150' setback to a cranberry bog on property <br />located in an R-3 zoning district at 10 Cranberry Lane (Map 23 Parcel 21) Mashpee, MA. <br />Sitting: Robert Nelson, Zella'Elizenberry, Richard Guerrerra, Frederick Borgeson, Evano <br />Cunha and Jonathan Forbush. <br />John Slavinsky of Cape & Islands Engineering represents the petitioner. She is seeking <br />to build two houses on two separate lots and since the zoning is 150' from any cranberry <br />bog that has been in existence for the past 5 years — she is seeking a 93' variance to build <br />on lot 44 and a 36' variance to build on lot 43. Lot 44 contains over 46,000 square feet <br />and lot 43 contains 13,000 square feet. There are several people in the audience who are <br />vehemently opposed to building so close to the bog. The abutters that spoke in <br />opposition to these variances are: Vicki Holmes, Dan Cronin, Jerry Thibideault. They <br />are all of the opinion that they want to preserve the bog view, they don't want the house <br />in the middle of the bog and they don't want a driveway/street that will be paved and <br />used unnecessarily. Mr. Slavinsky mentions that most of these people all have their 4 <br />bedroom houses built where they wanted them because this was not an issue 10 years <br />ago. He also mentions that lot 44 has over 46,000 square feet, larger than any of the lots <br />in that area. Mr. Cronin mentions that if they have that much land why cant they move it <br />back? Mr. Slavinsky says that putting a septic system uphill which is called breakout, is <br />not advisable, and since he believes that his client owns the cranberry bogs, she should be <br />able to build her house where she wants it.
