Mr. Slavinsky also mentions that there is a <br />well on an abutting property that the Board of Health is requiring them to stay 150 feet <br />from the leaching facility. The Board discusses lot 43 and mentions that it only contains <br />13,000 square feet. Mr. Slavinsky tells them they are utilizing other acreage in the area <br />to increase the size of the lot to attain the ability to build a 2 -bedroom house. Mr. Nelson <br />questions Mr. Slavinky on where that is detailed on the plan. He answers that it is not <br />necessary to show.that. Mr. Nelson feels otherwise. The Board asks what conservation <br />said about this property. Mr. Slavinsky tells them that they are quite happy with where it <br />is because it is a grassy area and no trees need to be taken down. Additionally, Mr. <br />Slavinsky informs the Board that this lot was created in 1986 and the acreage was put <br />together as such to make it a better buildable lot when the owner was ready to do so. Mr. <br />Guerrera feels they could move the house back and make everyone happy. After much <br />discussion between all parties, Mr. Nelson makes a motion to grant the 93' variance on <br />lot 44. Frederick Borgeson seconds the motion. Zella Elizenberry votes yes. Evano <br />Cunha votes yes. Jonathan Furbush votes yes. Richard Guerrera abstains from voting. <br />Motion carries. So moved. Robert Nelson makes a motion to deny without prejudice the <br />36' variance on lot 43. He would like petitioner to come back with the plan showing the <br />acreage he will be using and lot dimensions. Zella Elizenberry seconds the motion. All <br />agree. So moved. This request is denied without prejudice. <br />Other Business: <br />The Board discusses the article to be submitted for the warrant. Lori Corsi informs the <br />Board that Town Counsel has agreed that these motions are legal and appropriate to <br />submit. The Board reads the letter sent from Mashpee Commons regarding the 40B and <br />the suggested use of sub -committees to make this more manageable. Mr. Nelson agrees <br />to make arrangements to meet with Joyce Mason, Town Manager and John.Cahalane, <br />Chairman of the Board of Selectmen on this matter. The board will take the minutes <br />home and review. <br />Zella Elizenberry makes a motion to adjourn the meeting. Frederick Borgeson seconds <br />the motion. All agree.
