Mashpee Zoning <br /> Board of Appeals Howard Glaser <br /> 2 V-04-53 <br /> 397 Great Oak Road <br /> variance requests. This matter was continued from the June 23, 2004 hearing to <br /> determine where the curb cuts would be allowed from the DPW and to discuss this matter <br /> with Town Counsel. Mr. Slavinslcy has the curb cut permit from DPW and has made the <br /> changes to the driveway that Mr. Breen and the Board were concerned with. After <br /> further review of plans and questions back and forth from the board members,the new <br /> driveway proposal now gives cars a place to turn around before pulling out onto Great <br /> Oak Road Road which the Board feels is much safer. Mr.Nelson points out that on lot <br /> 403 Great Oak Road,he would like to see the deck reduced so that it stays out of the zone <br /> completely. Mr. Slavinsky agrees that no excavation will be done in the ACEC on that <br /> lot and signs the plans accordingly. Mr. Nelson makes a motion to grant a 20 foot <br /> variance to the ACEC on lot 397 Great Oak Road. <br /> GENERAL FINDINGS <br /> 1. the subject lot is located at 397 Great Oak Road and contains 24,460 square <br /> feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 3. that the <br /> affect the subject lot and not the district in <br /> shape p and topography <br /> which it is located. <br /> I <br />
