10 <br /> wn of Mashpee <br /> R <br /> ' IC) Great_deck Avood J�ortlz <br /> MASHPEE ZONING BOARD OF APPEAL�,lashpee Nlassachusetts 02( <br /> Decision for a Variance <br /> 16 Wilson's Grove Road <br /> RE; Beverly Plummer Map 118 Parcel 71 <br /> V-04-60 <br /> A Petition was filed on March 24, 2004 by Beverly Plummer for a Variance from <br /> Section 174-31 of the Zoning By-laws to vary the current setback requirements in order <br /> to rebuild an new dwelling on property located in an R-3 zoning district at 16 Wilson's <br /> Grove Road (Map 118 Block 71) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on March 26, 2004 and April 2, 2004, a copy of which <br /> is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 14, 2004 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James Regan,Robert Nelson and Zella <br /> Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents the petitioner at this <br /> hearing. She is seeking a special permit and a variance in order to demolish the existing <br /> dwelling on and rebuild a new house. The variances are necessary due to the small size <br /> of the lot and existing setback requirements. The Board feels this would be an <br /> improvement to the area and they make a motion to grant the following: <br /> ■ A 1,500 square foot land space variance <br /> ■ A 10-foot frontage variance. <br /> ■ An 8-foot front yard setback variance <br /> ■ A 5-foot variance on the northerly side <br /> A 6.5 foot variance on the southerly side <br />
