COMMONWEALTH OF MASSACHUSETTS
• BARNSTABLE, ss. SUPERIOR COU
OF THE TRIAL
CIVIL ACTION
•
0
THOMAS CHOATE,
Plaintiff,
COMPLAINT
V.
ZONING BOARD OF APPEALS OF
TOWN OF MASHPEE, ANTHONY
SHUMAN and DOROTHY KAGAN,
Defendants.
T DEPARTMENT
COURT
NO.
1. This is a zoning appeal action by an individual owner of
abutting property appealing the granting by the Mashpee Zoning
Board of Appeals of variances to defendants Anthony Shuman and
Dorothy Kagan for the residential property dots at 25 and 29
Pickerel Cove, Mashpee. The zoning relief approved by the Board
I
will enable the defendant -applicants to split their property,
consisting of two adjoining non -conforming lots which now provide
one buildable lot, into two buildable lots despite the lack of
adequate area, frontage and paved road accessi, under the current
Mashpee Zoning Bylaw. The grounds for this appeal are that the
defendant -applicants lacked a sufficient oasis for the variances
granted and the defendant Board failed to state valid grounds for
the issuance of the variance. Thus, the plaintiff requests that
the Board's action approving the zoning relief be annulled and
vacated.
