Town of Mashpee <br />MASHPEE ZONING BOARD OF APPEALS 16 Great JVeck load Xorth <br />Mashpee, Massachusetts 02649 <br />Decision for a Special Permit <br />Susan Joy 426 Cotuit Road <br />Owner of Record: Richard Blanchard Map 22 Parcel 43 <br />SP -03-49 <br />A Petition was filed on March 10, 2003 by Susan Joy for a Special Permit under <br />Section 174-25.A.8 of the Zoning By-laws to legalize an existing multi -family dwelling <br />into a single family dwelling with an in-law apartment on property located in an R-5 <br />zoning district at 426 Cotuit Road (Map 22 Parcel 43) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on March 14, 2003 and March <br />21, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 26, 2003 at which time the following members of the Zoning Board <br />• of Appeals were present and acting throughout: James E. Regan, III, Robert G. Nelson <br />and Richard Guerrera. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />GENERAL FINDINGS <br />1. that the subject property is located at 426 Cotuit Road and contains 13,730 <br />square feet of land. <br />SPECIFIC FINDINGS <br />The Board determined to allow: <br />1. conversion of an existing dwelling to accommodate not more than two (2) <br />families, provided that there is no external evidence of occupancy by more than <br />one (1) family, <br />2. and further provided that each dwelling unit resulting from such conversion shall <br />have not less than seven hundred fifty (750) square feet of habitable floor space. <br />• <br />
