Mr. Ferragamo answers some of the Board's questions and <br /> . after some discussion Mr.Nelson moves to grant a 7.7-foot variance in the front yard. <br /> Zella Elizenberry seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 12 Cross Tree Way and contains 14,400 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. aliteral enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. ' <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on August 13, <br /> 2003 to grant a 7.7-foot variance to Petitioner. This variance is conditioned upon <br /> architectural plans from Anthony E. Ferragamo, Registered Architect of Mashpee, MA, <br /> and site plans from Cape &Islands Engineering, File No. 109MA, dated July 18, 2003. <br /> nM 1\ <br />
