Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, November 28, 2003, and
• December 5, 2003 a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, December 10, 2003 and continued until January 14, 2004 at which time the
following members of the Zoning Board of Appeals were present and acting throughout:
James Regan, Robert Nelson and Richard Guerrera.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of
Mashpee Zoning By-laws.
Florence Wall represented the petitioner at this hearing. They are seeking to
install cooking facilities in the accessory structure already existing in the house. The
septic system has been addressed with the Board of Health and is issued as a 2-bedroom
dwelling. All other codes have been met with respect to the building codes. An abutter,
Mr. Richard Olsen, expresses his opposition over this petition with respect to John's
Pond. He feels granting the Florence's kitchen facilities would tie into the waste water
• and affect the pond.. After much debate, the Board continues the matter until January 14,
