Mashpee Zoning <br /> Board of Appeals Geoffrey Wall <br /> Z SP-03-156 <br /> 2004 so that a site visit can be made. At the hearing on January 14, 2004, Ms. Florence <br /> gives the Board many signatures in support of her petition. Again, Mr. Olsen states his <br /> opposition and submits a letter to the Board. The Board has made a site visit and feels <br /> that, along with the Board of Health's approval, petitioner should be given the Special <br /> Permit. The Board moves to grant the Special Permit. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 146 Ninigret Avenue and contains 6,263 <br /> square feet. <br /> SPECIAL PERMIT CRITERIA <br /> § 174-25.A.8 of the Zoning By-laws states: <br /> "Conversion of an existing dwelling to accommodate not more than two (2) families, <br /> provided that there is not external evidence of occupancy by more than one (1) family, <br /> and further provided that each dwelling unit resulting from such conversion shall have <br /> not less than three hundred (300) square feet of habitable floor space" <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. conversion of an existing dwelling to accommodate not more than two (2) families, <br /> provided that there is no external evidence of occupancy by more than one (1) family, <br /> 2. and further provided that each dwelling unit resulting from such conversion shall <br /> have not less than three hundred (300) square feet of habitable floor space. <br /> 3. The Board of Health shall have access for the purpose of inspecting the septic system <br /> every three years. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on January <br /> 14, 2004 to grant a Special Permit to complete the accessory structure as permitted by the <br /> requested relief sought and is granted in perpetuity. This permit is granted pending a <br /> • Sanitary Code Inspection of the dwelling before issuance of occupancy permit. <br />
