A service access may be provided to the pump <br /> house and landscape screen plantings shall be provided to mitigate the reduction <br /> in the buffer. In all other areas along Quinaquisset Avenue, the 50-foot buffer has <br /> been increased to 100 feet and an approved subdivision road curb cut has been <br /> eliminated. <br /> An area along the eastern border of the Project, specifically the southern and <br /> eastern side of proposed golf hole #22 and the northwest side of proposed golf <br /> hole#23. Variance relief requested is to zero in this area since the subject land is <br /> undeveloped and predominately owned by Willowbend Development Corporation <br /> and/or the Town of Mashpee and is the subject of a land exchange to be executed <br /> within the next month or so. Said land shall then revert to predominately open <br /> space for the Project and provide greater than the required buffer. <br /> Proposed construction of a small 20x24-foot rest station located between <br /> proposed golf green#22 and tee#23, adjacent to lake#22 lies 90 feet from the <br /> Project boundary. Variance relief requested is from 200 feet to 90 feet. The rest <br /> station shall be landscaped, connected to the Willowbend Sewer Treatment <br /> Facility and may contain the water transfer pumps required for water conservation <br /> measures as dictated by the Cape Cod Commission. <br /> NORTHERN AREA: <br /> An area on the northern section of the Project along the southern side of <br /> Sampson's Mill Road, between the intersections of the Town ancient ways known <br /> as Simon's Road and Mashpee Neck Road, and specifically in the <br /> area of proposed golf tee#17. The area required for buffer is currently <br /> ComElectric easement and shall remain as undevelopable open space. Variance <br /> relief requested is from 50 feet to 10 feet. Said area shall be supplemented with <br /> landscape screen plantings. <br /> No comments were received e ved from abutters. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requiresuires that the permit <br /> granting <br /> authority must <br /> determine that there are circumstances relatingto the soil conditions shape r <br /> � p <br /> 0 <br /> topography which affect the subject lot and not the district in which it is located, <br /> that a literal enforcement of the By-laws would involve substantial hardship to the <br /> petitioner, that desirable relief may be granted without substantial detriment to the <br /> public good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> SECTION 174-47.0 <br /> A minimum undisturbed buffer strip of fifty(50) feet in width shall be maintained <br /> between any area brushed or cleared for golf course or associated construction <br /> and any site boundary line or the street layout line of a public way, except for <br />
