Town o Mash ee <br /> N <br /> 4N� Decision for a Variance 16 Great J1�eck load J1�orth <br /> Mashpee, Massachusetts 02649 <br /> RE: Willowbend Development Corporation Golf Course Expansion V-02-16 <br /> A Petition was filed on December 14, 2001 by Willowbend Development <br /> Corporation of Mashpee, Massachusetts for a Variance from Section 174-47 of the <br /> Zoning By-laws to vary the setback requirements to allow for expansion of an existing <br /> golf course located in an R-3 zoning district in Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 21 and <br /> December 28, 2001, a copy of which is attached hereto and made apart hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 9, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Richard T. Guerrera, Frederick R. <br /> Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the j <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. I <br /> ii <br /> Mr. John E. McElhinny, Executive Vice President and General Counsel of <br /> Willowbend Development Corporation, Mr. Bruce A. Besse, Jr., Executive Vice <br /> President of Willowbend Development Corporation and Golf Course Architect, and Ms. <br /> Donna Bergamo, Legal Counsel for Willowbend Development Corporation, represented <br /> the Petition. Mr. Besse said that construction of the proposed golf course expansion and <br /> small rest station would encroach on the setback requirements in a few areas. Mr. <br /> McElhinny stated that the Petitioner has also worked closely with the neighbors, <br /> particularly those residing on Quinaquisset Avenue. He indicated that the neighbors <br /> expressed preference for construction of a proposed golf course expansion over the <br /> development of 77 new homes in the area. <br /> i <br /> Mr. McElhinney asked for a continuance of the Petition to allow an opportunity j <br /> for the Petitioner to receive the Cape Cod Commission's final Development of Regional <br /> Impact Decision. <br /> The Board voted unanimously to continue the Petition until February 27, 2002, at <br /> which time the Petitioner is required to submit a document outlining the specific <br /> Variance relief being requested. <br /> At the continued hearings on February 27, 2002, Mr. John E.
