Town o Mash ee <br /> � sSryg <br /> /y 16 Great Xeck -oad Xorth <br /> �IgN�ADIE� MASHPEE ZONING BOARD OF APPEALSMashpee,Massachusetts 02649 <br /> i <br /> Decision for a Special Permit <br /> RE: Richard Halpern, Trustee SP-02-27 100 Great Neck Road North <br /> Map 45 Parcel 3 <br /> A Petition was filed on December 26, 2001 by Richard Halpern, Trustee, River <br /> Bend Realty Trust of Mashpee Massachusetts, for a Special Permit under Section 174-17 <br /> of the Zoning By-laws to alter a pre-existing, non-conforming structure with the addition <br /> of a canopy on property located in an R-5 zoning district at 100 Great Neck Road North <br /> (Map 45 Parcel 3) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 23, 2002, at which time the following members of the Zoning Board Ij j <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of l <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kirrane represented the Petitioner and said that the subject <br /> property was developed prior to the adoption of Zoning by the Town. The re-existing, j <br /> non-conforming use includes the existence of multi-family units and a commercial <br /> business that is being conducted within a residential zoning district. Plans call for <br /> construction of a canopy and deck along the front of the building, which would replace <br /> the existing dilapidated overhang. The Petitioner, Mr. Richard Halpern, also attended the <br /> meeting and said that the proposed canopy would provide shelter from the elements and <br /> would allow access for limousines and trucks. The proposed deck would be installed for <br /> aesthetic reasons, which would also provide fire escape in case of emergency. <br /> Mr. John Cahalane, Chairman, Board of Selectmen, attended the meeting and said <br /> i <br /> that he would welcome any improvement to the front of the building and expressed <br /> approval of the proposal. j <br /> I <br /> The Design Review and Technical Review Committees have approved the <br /> proposal. <br /> No comments were received from abutters. <br />
