Mashpee Zoning Richard Halpern, Trustee SP-02-27 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Changes, extensions or alterations of non-conforming single- or two-family <br /> dwelling structures which do not meet the applicable dimensional requirements as set <br /> forth above, and changes, extensions or alterations of all other non-conforming structures, j <br /> or non-conforming uses, may not be made unless there is a written finding by the Board <br /> of Appeals that such change, extension or alteration shall not be substantially more j <br /> detrimental than the existing non-conforming structure or use to the neighborhood and <br /> that there is adequate land area to provide sufficient parking and setbacks as may be <br /> required. j <br /> i <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 100 Great Neck Road North and consists <br /> of more than 6 acres of land. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> I <br /> 1. there is adequate land area to provide sufficient parking. <br /> 2. the proposed addition of a canopy would be an improvement to the existing <br /> structure; therefore, the changes will not result in a structure or use which is <br /> more detrimental to the neighborhood than the prior non-conforming structure <br /> and its use. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on January <br /> 23, 2002 to grant the request for a Special Permit. The Special Permit is subject to the <br /> following: <br /> I <br /> 1. Cape & Islands Surveying, Inc. plan entitled `Plan of Land Located in <br /> Mashpee, Mass., Prepared for River Bend Realty Trust, Date: Mar.13, 1986, l <br /> Rev'd: 10/29/01'. <br /> 2. that the Petitioner shall remove the red lighting currently installed at Level <br /> One from the building. <br /> 3. that the Petitioner shall remove the `Nibbles' sign and the `Craft' sign from <br /> the building. <br /> 4. before a building permit will be issued,the Design Review Committee must <br /> visit the subject property and confirm that the Petitioner complies with all the j <br /> requirements of the Design Review Committee concerning the building and i <br /> landscaping. <br /> , I <br /> 5. before a building permit will be issued,the Petitioner must comply with all <br /> requirements of the Technical Review Committee. <br /> I <br /> I; <br /> I j <br /> i <br /> `Aa <br />
