Mashpee Zoning Minutes—February 27, 2002 6 <br /> Board of Appeals <br /> i , <br /> Mr. Brem questioned why the Petitioner is requesting a Special Permit when no Variance <br /> relief is being sought and whether the proposal would render the structure no longer <br /> non-conforming. Mr. Regan explained that the Petitioner must seek a Special Permit j <br /> from the ZBA to allow for additions to a pre-existing, non-conforming structure. He also <br /> said that the Board can grant the Special Permit if it find that such additions would not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming <br /> structure. I l <br /> i9 <br /> Mr. Regan questioned the difference insquare <br /> footage and the lot lines between the <br /> engineering plans and the assessors map concerning the subject lot. Building I' <br /> Commissioner Wheeler informed the Board to use the lot size figures as calculated on the <br /> engineering plans. Ms. Elizenberry questioned the lot coverage. Mr. Brem estimated <br /> that the proposed lot coverage would be below the allowed 20%. Mr. Regan said that the <br /> proposal would be a vast improvement. <br /> No comments were received from abutters. <br /> Ms. Elizenberry moved to grant the Special Permit, subject to the following: <br /> i' <br /> • findings 1, 3, 4, 5, 7. All agreed. j <br /> Willowbend Development Corporation—Requests a Variance from Section 174-47.0 <br /> of the Zoning By-laws to vary the setback requirements to allow for expansion of an <br /> existing golf course located in an R-3 zoning district in Mashpee, Massachusetts. <br /> Continued from 1/9/02 and 1/23/02 to allow for Cape Cod Commission approval. <br /> I'' I <br /> Sitting: Richard T. McElhinney, Executive Vice President and General Counsel of Willowbend � <br /> Development Corporation, and Mr. Bruce A. Besse, Jr., Executive Vice President of � <br /> Willowbend Development Corporation and Golf Course Architect represented the r l <br /> Petition. Mr. Besse stated that the Cape Cod Commission has approved the proposed <br /> golf course expansion with many comprehensive conditions and findings. The proposal <br /> is currently under review by the Planning Board and Conservation Commission. Mr. <br /> Besse said that some of the benefits from the proposal that the Town would enjoy include <br /> the following: <br /> • a 9-hole golf course would be constructed instead of 77 house lots. <br /> • environmental enhancements, such as implementation of water conservation <br /> techniques, a$56,000 traffic mitigation and enhanced habitat areas. <br /> i <br /> i <br />
