Crocker, Jr. SP-02-87 <br /> 4 <br /> excessive demand on community facilities, will provide adequate off-street <br /> parking, will not cause excessive erosion or cause increased runoff onto <br /> neighboring properties or into any natural river, stream,pond or water body and <br /> will not otherwise be detrimental to the town or the area. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules <br /> and regulations. <br /> II' <br /> 2. there will be no adverse effect on public health or safety. I i <br /> 3. there will not be an excessive demand upon community facilities created as a <br /> result of the proposal. <br /> 4. there will not be a significant adverse impact on the environmental factors <br /> listed in Section 174-24.C.2. <br /> 5. the proposed use, which while not specifically allowed by right or by Special I' <br /> Permit in the district, is similar to other uses allowed by right or by Special <br /> Permit and substantially dissimilar to prohibited uses. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the ! <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion ` I <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on October 23, <br /> 2002 to grant a Special Permit. <br /> The Special Permit is conditioned upon compliance with the following: <br /> 1. Plans from Baxter,Nye&Holmgren, Inc.,of Osterville, Job#2001-120, ! <br /> dated March 21, 2002, revised May 13, 2002, revised June 7, 2002, <br /> revised June 25, 2002, revised July 9, 2002, revised October 16, 2002 and <br /> accepted with final revisions on October 23, 2002. Additional landscaping <br /> plans numbered C-7 that were presented to the Design Review Committee { �, <br /> and accepted. <br /> I <br /> 2. Petitioner must submit a landscaping bond. Amount to be determined by <br /> Building Commissioner and Design Review Committee. <br /> I <br />
