Notice was given by publication in The Mashpee Enterprise, a <br /> p <br /> newspaper of general circulation in the Town of Mashpee, on August 9 and August 16, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 28, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G. Nelson, Marshall Brem and <br /> James E. Regan III. <br /> i <br /> j <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the a <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petitioner and <br /> stated that plans call for construction of a commercial building Y <br /> with contractor bays on <br /> the presently undeveloped lot at 68 Nicoletta's Way. The Design Review Committee and <br /> The Technical Review Committee have reviewed the proposal. <br /> Mr. Sidney Heimberg, a resident of 39 Sturgis Lane, expressed concern regarding <br /> the dirt and dust created b all of the commercial traffic. He also asked d about the <br /> landscaping plans. <br /> SPECIAL PERMIT CRITERIA <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law requires <br /> that the permit granting authority determine that the proposed use and development are <br /> consistent with applicable law,rules and regulations; that there will be no adverse effect <br /> on public health or safety; that there will not be an excessive demand upon community I <br /> facilities created as a result of the proposal; and that there will not be a significant <br /> adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> � j <br />
