Mashpee Zoning Stephen Giatrelis SP-02-90 <br /> Board of Appeals 2 <br /> Section 174-24.C.2. <br /> A special permit may be issued only following the procedures specified by the General <br /> Laws and may be approved only if it is determined that the proposed use or development <br /> is consistent with applicable state and town regulations, statutes, bylaws and plans, will <br /> not adversely affect pubic health or safety, will not cause excessive demand on <br /> community facilities, will not significantly decrease surface or groundwater quality or air <br /> quality, will not have a significant adverse impact on wildlife habitat, estuarine systems, <br /> traffic flow, traffic safety, waterways, fisheries,public lands or neighboring properties, <br /> will not cause excessive levels of noise, vibrations, electrical disturbance, radioactivity or <br /> glare, will not destroy or disrupt any species listed as rare, endangered or threatened by <br /> the Massachusetts Natural Heritage Program or any known historic or archaeological site, <br /> will not produce amounts of trash, refuse or debris in excess of the town's landfill and <br /> waste disposal capacities, will properly dispose of stumps, construction debris, hazardous i. <br /> materials and other waste, will provide adequate off-street parking, will not cause <br /> excessive erosion or cause increased runoff onto neighboring properties or into any <br /> natural river, stream <br /> and <br /> p or water body and will not otherwise be detrimental to the I i' <br /> town or the area. <br /> Section 174-25.D. <br /> 1 allows for: <br /> Business, financial, professional or governmental offices, but no retail business' no " ! <br /> manufacturing and no processing. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located on 68 Nicoletta's Way in an I-1 zoning <br /> district and consists of 6.51 acres. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the development is consistent with applicable law, rules and regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> .I, I <br /> 3. there will not be an excessive demand upon community facilities created as a <br /> result of the proposal. <br /> li <br /> 4. there will not be a significant adverse impact on the environmental factors <br /> listed in Section 174-24.C.2. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the grantingof a Special Pe <br /> p Permit <br /> Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on August 28, <br /> 2002 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> 1. Cape& Islands Engineering plan entitledPro osed Site Plan Located in <br /> « p <br /> Mashpee, Mass., Prepared for Steven Giatrelis, Date: May 14, 2002". <br /> 8 <br /> 2. an $8,000 Landscape and Performance Security, which was secured with the <br /> Treasurer's office on September 4, 2002. <br /> ' I! <br />
